    Under FSA2013 the only AR-15 in .223/5.56 caliber that is legal to purchase, sell or transfer has to be HBAR/heavy barrel because all AR-15s in .223/5.56 are banned except the Colt HBAR sporter, which is allowed by name. Copies of named firearms are also banned or allowed as applicable.

    Nope. 100% true. Also an ar pistol is legal with any caliber/profile, NFA rules still apply with some additional restrictions.

    Nowhere in the law does it specify caliber for an AR-15.

    Colt AR–15, CAR–15, and all imitations except Colt AR–15 Sporter H–BAR rifle

    So ALL AR-15s or imitations are banned.

    And while the AG has put out guidance on a COPY, an IMITATION is not the same thing.

    MSP seems to be taking the stance that caliber does matter, but that does not make that the law.

    I'd argue that the AR-15 and CAR-15 are .223/5.56 rifles. A 6.5 Grendel is built on an AR-15 platform, but is substantially different. A .300AAC blackout is also built on an AR-15 platform, but has a different barrel/chamber.

    To me at least, yeah we call them AR-15s if they use an I modified AR-15 lower, but I don't think of them as actual AR-15s, but AR-15 platform rifles. Apparently MSP also takes that view (thank god for a little sanity).

    The point in part though is that because the Colt HBAR sported is legal, imitations and copies of it are also legal. The only thing that notably distinguishes a Colt HBAR sported from a regular AR-15 is the use of a heavy barrel. So to be an imitation of the Colt HBAR sported, the rifle would have to be an AR-15 in .223/5.56 with a heavy barrel.

    MSP is taking the AG's letter on copies to include the caliber, per AAG Bowen at MSP.
