    So, here’s an earnest question:

    Isn’t condemning someone for being “in favor of ERPOs” without any discussion of whether or not a given statute does or doesn’t have any provision for due process, kind of like painting “immigration” with a clumsy broad brush that pretends there’s no distinction between legal and illegal?

    Is there no example of any state law that can, with due process, prohibit a dangerous person prior to an actual conviction or lengthy institutionalization? Yes, we need people like Graham to make to distinction between red flag laws that do and do not provide due process. But everyone here knows that most of the high profile mass shootings that are powering the left’s attack on our rights are done by crazy people. The focus on that, instead of on mag capacities and triggers, is 100% where it should be. But we need better language - “red flag” is not a useful phrase without the nuances.

    I just don't get the whole ERPO concept. If a PERSON is deemed to be a threat to others, shouldn't the PERSON be confiscated? :mad54:

    Does any passage of a fed bill with due process change the no due process here in MD? Kinda sounds like another inch ....

    If the person isn’t enough of a threat to have them either A) confined against their will until deemed not a threat or B) convicted of a crime and jailed for life; then they are not a threat and are instead citizens owed full constitutional rights.

    Any ERPO where the burden isn’t on the state to overwhelmingly prove your status as a “threat” beyond any doubt is an affront to the ideals behind the country itself.

    I'm sorry I have nothing bad to say about LE .I dont like what Lindsay and Blum are working on if i understand what little he said it but giving LE the right to make a decision on taking guns from a person that said something haven't we all said something we regret later. LE Phycologist

    That costs money. There is an entire industry devoted to keep confiscated people away from the general citizenry.
