Man I did not do to hot in ConLaw, but there is a good argument to assert that the Executive Privilege claim survives past the term of a President. In other words, absent a judicial order, the claim survives post-term unless it is waived by the former President.

The claim of EP can be tested in court. Another reason not to vote for a candidate who has no chance of winning. Unless, of course, you were going to vote for Zippy and now decide to vote for the two chicks running on the Green Party.

Never gonna happen. He will be thinking about what happens when he leaves office. There is a longstanding tradition (motovated by self-interest) to forgive and forget. If it were otherwise, you had better believe that Obama would have Rumsfeld in Gitmo now standing trial for torture or war crimes or both.
