    Firearm Purchase Delay Legislation Is Now in the Senate

    CALL TO ACTION


    House Bill 325 has passed the House, relying upon fraud and deception to win approval, and is now in the Senate awaiting action. This misguided legislation would go beyond federal law and extend the 3-day transfer period for NICS delays to 30 days --- and more. Please contact your Senator and politely urge them to oppose House Bill 325 when it comes up for a vote.


    But here's the real story....... HB 325 creates a "black hole" that results in a never-ending cycle which deprives law-abiding citizens of their right to keep & bear arms... and the sponsors knew it when they chose the 30 day "delay"........
    • Fact #1: The overwhelming majority of gun buyers in Delaware who are "delayed" in NICS checks are law-abiding citizens who are eventually "cleared".
    • Fact #2: As many as 40% of all gun sales in Delaware are delayed during NICS checks.
    • Fact #3: If you were in the military or other government service and held a security clearance, your chance of delay is very high - and the higher the clearance, the higher the probability of delay - and the higher the clearance, the longer the delay.
    • Fact #4: Under the current law, an FFL may (but is not required) to complete the transaction if the FBI's NICS Center does not call back within 3 business days - (It's actually 5 days because neither the first or last day count).
    • Fact #5. Over the last two (2) years, only 16 firearms were transferred in Delaware after the mandatory 3-day delay - and all of them were recovered by BATF with no crime being committed.
    Now here's what they are not telling you.........
    and what they didn't tell the House!!!!
    • Fact #6. A NICS Check is only good for 30 days - and the 30 days begins when the check is initiated (called in) - under HB 325 that creates a "black hole" - with a 30 day delay you could never get approval - the House Sponsors knew it and told no one.
    • Fact #7. If HB 325 passes the Senate, then the FBI could simply delay all Delaware checks for 30 days and NO ONE could buy a gun in Delaware
    Current law allows a federally licensed firearms dealer (FFL) to release a firearm after 3 business days if they have not received any additional correspondence from NICS after receiving a "delay" when conducting the initial background check for the firearms transfer. This safeguard prevents the potential shutdown of sales via endless delays and allows law-abiding individuals to take possession of a firearm in a timely manner. House Bill 325 is a solution in search of a problem and your legislators need to hear from you!

    What will happen if HB 325 is enacted is:

    The FBI's NICS center will be able to unilaterally delay all transactions in Delaware for up to 30 days... and as understaffed as they are you better believe that Obama's Justice Department will do exactly that - and so would a Sanders Justice Department and a Clinton Justice Department - we know that because that's exactly what they tried to do when Bill Clinton was President.



    At best, HB 325 is nothing more than a 30-day waiting period in disguise -and at worst it creates a "black hole" which could mean a total ban on gun sales in Delaware.

    It is also a solution in search of a problem.... There is no evidence that any problem exists in Delaware as a result of the current system - so why are they doing it? Because they think they can - and because they know exactly what the end result will be - a 30 day waiting period, across the board in Delaware.

    Call and/or email each member of the House Administration Committee and politely ask them to oppose HB 325 and to vote NO on HB 325.

    HCR85 - Creates Suicide Prevention Task Force

    This LOADED TURD is comprised of the following:

    BE IT FURTHER RESOLVED that the Firearm Suicide Prevention Task Force shall be composed of the following members:

    1. Two members of the House of Representatives appointed by the Speaker of the House;
    2. Two members of the Senate appointed by the President Pro Tempore;
    3. A representative from the Office of the Governor, appointed by the Governor;
    4. The President of the Delaware Sportsman Association or the President’s designee:
    5. A representative from the National Rifle Association appointed by the Governor;
    6. A representative of the Commission of Veterans Affairs appointed by the Governor;
    7. The Secretary of the Department of Health and Social Services or the Secretary’s designee;
    8. The Secretary of the Department of Children, Youth and Families or the Secretary’s designee;
    9. The Secretary of the Department of Natural Resources and Environmental Control or the Secretary’s designee;
    9. Two Delaware firearm dealers appointed by the Governor; and
    10. Two representatives of suicide prevention organizations, one appointed by the Speaker of the House and one appointed by the President Pro Tempore of the Senate.

    BE IT FURTHER RESOLVED that from among the appointed members, the Speaker of the House of Representatives shall appoint a co-chair and the President Pro Tempore of the Senate shall appoint a co-chair, and the co-chairs may add members to the Task Force as they deem necessary.
    BE IT FURTHER RESOLVED that the Speaker of the House and the President Pro Tempore of the Senate shall assign reasonable and necessary support staff for the Task Force.
    BE IT FURTHER RESOLVED that the Task Force shall convene in August 2016 and shall submit a report of its findings and recommendations to the members of the Delaware General Assembly by December 15, 2016.

    I'd bet the bank that Miller's is one of the dealers picked.

    THERE IS ZERO CHANCE OF ANYTHING GOOD COMING OUT OF THIS.


    HB401 - Doubles and Triples Hunting/Fishing/Trapping License Fees Under the Guise of "Conservation"

    Just a money grab and further restrictions on freedoms.

    HB410 - Opens Up Expungement Process, Governor Discretion to Pardon and Restore Civil Rights including Right to Purchase/Possess Deadly Weapons

    Helps the "Judicially Involved" get a job. Gives the Governor the option to restore Gun Rights, not that it would actually happen. Could be a positive with a R Gov if DE ever gets one.

    This may get bogged down. There are a total of 9 amendments that have been introduced. It's my understanding they still have budget stuff to do and I believe we are close to end of session.

    No vote today, not currently on the calendar (likely to change). It's their "moment to do something" so we'll see.

    Looks like it passed around 6:20pm this evening.

    It was cut back to a 25 day wait period. Gee thanks!

    The GOV is wasting no time politicizing "his success". He is expected to sign this unconstitutional infringement tomorrow.

    The updated language was not on the DE GOV website yet. I don't know if any no-fly BS was added.

    Delaware: “Terrorist Watchlist” Legislation to be Considered by Senate Tomorrow

    Today, anti-gun lawmakers in the Delaware Legislature introduced “Terrorist Watchlist” legislation, Senate Bill 287, which lacks due process. In a procedural move to fast track the legislation without public input, the rules have been suspended to bring it to the Senate floor first thing tomorrow. It is imperative that you contact your legislators immediately and politely urge them to OPPOSE this legislation.


    Senate Bill 287 seeks to remove the right to due process of those on the “Terrorist Watchlist” when taking away their firearm rights. Individuals may be added to the watchlist without being charged or convicted of any crimes, and those on the list are never notified if, how, or why they are on the list. There is no process in place to have your name removed from the list, and mistaken identities are common. In every other case in which a person is deprived of their firearm rights, they are afforded a judicial proceeding. Due process of the law must be followed before depriving anyone of their Constitutional rights.

    I posted a response to an article on Delmarva Now.

    "There is so much misinformation in this article that it's truly sad. The 3 day rule only applys to someone that initially fails their NICS check. Granted the person could actually be someone that shouldn't own a firearm and that's a good thing. However, sometimes the system has a glitch and fails someone that shouldn't be. The 3 day waiting period by the FBI was designed to allow them to take a second look. If the gun dealer doesn't hear back in that time frame, the purchaser is good to go. It was designed this way to give the FBI some accountability to process transactions in a timely matter. Now let's look at the new Delaware law increasing wait times to 25 days. Here's what's going to happen. Someone gets declined in Delaware who shouldn't have. Three days pass and the FBI decides there is no reason to deny. The application gets dumped into some bit bucket somewhere and forgotten. They won't continue to research for the next 22 days. Now you've just made a legal citizen wait 22 extra days for no reason at all. So yeah....this bill does nothing...truly. For those that are unfamiliar, I suggest you Google Fed Form 4473. This is the form everyone has to fill out to purchase most firearms."
