    This is a good point. A "recess" SCOTUS appointment might be over the top, but some other federal judge appointments (which hold a ton of power considering most things never see the light of SCOTUS) might go relatively unnoticed by the mainstream sheeple.

    I think you will find that it is 60% of the members present. One of the reasons that Representatives and Senators cannot be arrested while in transit to Congress to vote. Just imagine the minority party having the majority party's Senators arrested on their way to Washington DC.

    Also, how did the Senate conduct any business during the Civil War? There were only 66 Senators in 1861. A percentage stands the test of time and expansion.

    The senate rules change regularly. They vote on them at the beginning of each session, IE every 2 years. The 60 person threshold, I believe, was put in by the D's several years ago to end debates and was considered the nuclear option. It was higher before that. They did it to stop the filibusters that Republicans threatened and to help push through things like the ACA.

    Yeah, the thought came to me earlier because of the link on a previous page ... it said Teddy Roosevelt enacted 168 recess appointments. Makes ya wonder how far O would go.

    Whatever he thinks he can can get away with. Or even just to throw a monkeywrench into Trump's works.

    His administration's dismal record before SCOTUS, including his unilateral fabrication as to when Congress is in recess for recess appointments, slapped down 9-0 by SCOTUS, tells you that his dogma and socialist agenda trump the rules, laws, and Constitution.

    Wondering what he and the Dems will concoct tomorrow at their meeting on the Hill to try to save -0-Care. Or, whatever they're really meeting about.

    Counting the hours, not just the days until his arse is out of there and he can only cause trouble as a private citizen.
