Still not clear on C&R Sales in MD

    C&R handguns do not require a HQL at all under any circumstance.

    The one exception I've seen is when a particular LGS insists the buyer have the HQL (for a shop sale or transfer), in which case you take your business elsewhere.

    Why not just go to MSP? It's only $10.

    I don't think the MSP knows C&R from non C&R.

    Not there job to know and I don't think they'll take our word for it.

    I think they'll treat it like every other handgun in Maryland.

    Am I missing something here?

    I sold a few C&R handguns at MSP barracks. I just check the block on the application that says its a C&R gun on the application and they process. Simple.

    So no waiting period at all? They just let it go right then and there? Then I come home and put it in my A/D book?

    I'm talking about a non C&R selling a C&R to a C&R.

    It is definitely their job to know about the C&R exemption. I've transferred two C&R handguns with MSP without any issues. Besides not requiring a HQL, it is handled like any other handgun sale before October 1st. 8 day release after the paperwork is done.

    That's correct. MSP and MD require the buyer and seller to know and follow the law. Except in egregious situations, MSP will take the seller's word for it and process the sale as C&R. If MSP learns later that the law was violated if the handgun was not C&R eligible, then at least the seller faces arrest and prosecution and the buyer forfeits the handgun. The buyer also faces arrest and prosecution if a prosecutor can determine that the buyer knew the handgun was not C&R.

    Yes, unfortunately. That's why most all of my C&R handguns are purchased out of state.

    Jeez. The ONLY time you will ever use your C&R license in the state of Maryland is when you PURCHASE a C&R firearm from an out of state seller. You DO NOT use it to sell a firearm.

    I ain't making this up. The Introduction paragraph to ATF Pub 5300.11 says, "The sole intent and purpose of the collector's license is to enable a firearms collector to obtain curio or relic firearms from outside his or her State of residence."
