    Now that the SC is in our favor can the cases that the Court refused to take on be re-filed?

    You'd need to bring a new claim from the district up.

    It's better to wait for one of the 9CA cases to be heard then bring a new case with that precident.

    Just because we have a new SC Judge don't think things will always go our way. If some has been returned to the lower court the filing will have to be on a different ground. So each has to be relook closely.

    Regardless of the case, i would venture that the first gun issue, should it select a case, will be whether the ban CC or so called assault rifle/hi cap mags) will be whether its a core constitutional right and what level of constitutionsl scrutiny should be applied...strict or intermediate. When intermediate scrutiny is applied the law will stand.
