    Are 37 MM WWII flare pistols considered a pistol under Maryland law and therefore in need of a 77R? How about other older Brass Flare pistols?

    If it was designed for flares and not readily able to properly shoot pistol or rifle ammo, no.

    USCG-approved signal pistols (devices) are specifically exempt from being considered handguns under MD law (5.102(9)),
    hence being able to buy them at the local Wal-Fart.

    As for flare guns in general, well... technically they are considered handguns per 5.101(n)(2). Or NOT, per 5-132(4). :innocent0

    If you have an FFL-03 and buy from out of state, no worries either way.

    What you actually is a Walther Marine Flare pistol... in the early 1980s you could buy one, though they we a bit pricey.

    Turns out they would accept 40mm grenades. ATF went and got them all back...
