    Just don't see how this could be a loss. The county attorney had really no answers for the judges questions. And even conceded several points. While plaintiff attorney was definitely visibly nervous they judges clearly got his point and used it against the county attorney. So even a win here would likely be struck down enbanc it might serve as a good scotus case if another Trump Justice makes before this case does.

    Either the appeals court,or an banc would be ballsy to say there is no 2A constitutional right outside the home.

    Congratulations! To win a case like this in the State of Hawaii, really speaks volumes to your abilities and those that assisted you in this endeavor. It's a shame Maryland's Law and outlook hasn't be overturn, based on many of the cases cited.

    Nice job! My only issue with the opinion is that it places too much emphasis on the fact that NY, NJ, and MD issue SOME permits, whereas Hawaii issued none. This implies that Hawaii can grant a few to certain connected people and satisfy the scrutiny level.

    Did read the dissent incorrectly?

    Because the south had racist views and restricted firearms from blacks, that means its OK for the states to restrict firearms as a standard practice?

    If a civil right applies to everyone. Then how does one prove "one is engaged in the protection of life and property" if you are not a security guard or police officer? The state seems to imply that you have to be successfully "harmed" to warrant the ability to open carry.
