    Hmmm...In 42 out of 50 states, one does not need a "good and substantial reason" to carry a firearm in public. Guess Toby and Susan really shouldn't use that as an argument. :sad20:

    Hmmm...In 35 out of 50 states, one does not need a "good and substantial reason" to carry a firearm in public. Guess Toby and Susan really shouldn't use that as an argument. :sad20:

    Agreed. This is a stupid hill to fight on. Total no-win scenario for Harris. If he wins, he looks like a heavy handed tyrant trying to crush public access to what should be a public meeting about a public matter. If he loses, he’s a laughing stock because he got owned by a 20 year old stoner.

    I don’t know who is advising Harris on this mess, but they need to be unemployed like yesterday.

    Stuff like this are the dreams of political ads.

    Disagreed. This meeting between the young stoner and a Harris staffer was not subject to the Open Meetings Act. Young stoner was told that he was violating the law, given an opportunity to stop and chose not to.

    If he doesn't like the law then the young stoner can lobby his legislature to change it or do it through the courts by becoming a defendant. He is well on his way to option B.

    I believe the real issue that cause the problem was that he told the staffer he did stop, but secretly kept recording

    Gonna have to check in with the boys in Vegas to see what the odds are on the young stoner keeping his nose clean for the next 36 months. I wouldn't be a paycheck.

    IANAL and am embarrassingly behind on MD cannabis laws.
    Would him having his "green card" make him exempt from violating his probation for a positive UDS? Or would it be different for supervised/unsupervised probation?


    Maybe your Vegas homies will be able to factor that in because I'm lost in the sauce

    Possibly.

    For the delegate’s situation, if it is a public event then wire tapping laws don’t apply (it doesn’t have to be open to the public, if it has the appearance of a public event then it is sufficient to over ride any expectation of privacy).

    Keep in mind, the same legislature that was the last in the country to remove unconstitutional “do not film” laws related to police in public places. Blatantly unconstitutional and SCOTUS struck down several such laws, but it took a particularly nasty incident of BPD seizing someone’s phone filming an arrest and destroying the recording, as well as throwing the guy in jail for a couple of days and charging him to finally get it overturned. Every court up to SCOTUS threw MD out on its ear, and quickly.

    IMHO MD should join all the other states as one party consent states.
