    Hi, I am curious about the legality of airsoft or bb guns in the chevy chase area. I don't plan on shooting them or carrying them out in public, I am using them as props. Is it legal to own them? I heard that just possessing or owning them is illegal in Baltimore and I want to make sure that Chevy Chase isn't the same. Thank you

    In Montgomery County if you are a legal United States Citizen or Resident pretty much everything is illegal. Shooting them in your own back yard could be considered brandishing and could land you jail time and prohibit you from owning firearms for the rest of your life. However if you are an illegal alien and you steal weapons from a police cruiser and then bring them to your high school leaving them in plain view in your stolen car apparently thats totally OK!     In Montgomery County if you are a legal United States Citizen or Resident pretty much everything is illegal. Shooting them in your own back yard could be considered brandishing and could land you jail time and prohibit you from owning firearms for the rest of your life. However if you are an illegal alien and you steal weapons from a police cruiser and then bring them to your high school leaving them in plain view in your car apparently that totally OK!     Here's the article where the State let him go despite Federal Authorities pleading with them not to. Luckily I.C.E. was able to eventually track the teen down and I believe he will be deported soon if that hasn't happened already. What a place to live.     If you pulled crimes like this you'd probably be looking at around 15-20 years minimum.

    Wow that kid stole a gun from a cop car, never heard of someone crazy enough to do that. Anyways, can I own an airsoft gun within my own house or is possession illegal?

    The problem is some of these threads are years old and Ive heard that Maryland has recently looked into banning airsoft guns from being owned by people. As a result, I am looking for an up to date information on the matter.

    OP try going to the Introduction thread and using it. Then provide a little more info about your situation and you may get a less fecetious is answer. Most on these threads are tired of being trolled and dragged into innane discussions about the purported legality of toy/training devices available for purchase in most Walmarts, when truly lethal firearmans can be purchased at the gun store down the street. Of course if all else fails you chew a pop tart into the shape of Florida, but I don't recommend doing so without first obtaining your PQL.

    If you are suggesting looking up this problem on google then I can tell you I already have and I even tried calling different police stations but they weren't any help because theyre either outdated or aren't even sure on the subject. I even tried calling the fire arms division of a local police station but they don't answer the phone. Ive played with the google results to find current threads and I couldn't find anything. So if anyone knows of the laws in chevy chase regarding this subject, please let me know.

    I doubt they're banned in Chevy Chase. Stop by a Walmart in your county and go to the sporting goods section. If you see airsoft guns for sale, you're good to go.

    Eta: this place is in Montgomery County, suggesting there is no ban there. Give them a call ...

    Thanks for both links. MoCo must think he's a dreamer and can't be responsible for his actions even if they include theft of firearms from a police vehicle. Just dreaming for a better life of course.

    Notable how this word has been co-opted. No longer illegal aliens, no longer undocumented aliens, but now dreamers (if 21 or younger). As if other American youth don't have dreams and aren't worthy of the designation.

    Airsoft guns are perfectly legal to own in MoCo, but, IIRC, you can't discharge them in the suburban areas unless you have a "basement range".

    I'll endanger my usual paranoid crumugon status, and give a short and oversimplified answer :

    Legal to purchase and own .
    Illegal to shoot. (For OP's stated area)
    If a left wing soccer mom ever sees it , and "feels scared" , you are subject to same charges as real handgun ( very serious ).

    I have posted this before, so I'll do it again. MoCo Code, Chapter 57, Section 57-1: Definitions:
    Gun or firearm: Any rifle, shotgun, revolver, pistol, air gun, air rifle or any similar mechanism by whatever name known which is designed to expel a projectile through a gun barrel by the action of any explosive, gas, compressed air, spring or elastic.

    So yes, a spitwad through a Mickey-Ds straw is a "firearm" in Montgomery County, as are Airsoft and BB guns. Read the entirety of Chapter 57 to see what restrictions apply to your specific situation.
