    Maryland Dealer Bill to be Heard Thursday
    Contact the Chair and Vice-Chair of the Senate Judicial Proceedings Committee Today

    On Thursday, February 20, the Maryland Senate Judicial Proceedings Committee is scheduled to hear Senate Bill 816. While the bill has been titled, the “Firearms Dealers’ Safety Act,” it does nothing to promote public safety, but it does mandate burdensome and even some unattainable requirements for firearms retailers. See below for a full breakdown of the requirements set forth in SB 816.

    FFLs should contact the Senate Judicial Proceedings Chair, Sen. Will Smith at 410-841-3634, and Vice-Chair (also sponsor of the bill), Sen. Jeff Waldstreicher, at 410-841-3137 today to voice your concerns and opposition to SB 816. Let them know how this bill will affect your business operations.

    Senate Bill 816 requires the following of those who possess a Maryland Regulated Firearms Dealer License:

    Requires electronic keeping of records of all receipts, sale, and other dispositions of firearms
    Requires records to be updated within one (1) business day after the acquisition of a firearm
    Requires records to be updated within seven (7) days after the sale or disposition of a firearm
    Requires video and audio recording of all receipts, sales, disposition and for that video and audio to be kept for one (1) year
    Requires video and audio recording be made available to following: The Secretary, federal agency in connection with an investigation, party to a civil action after receiving a subpoena or discovery request
    Requires dealers to develop and keep written standard operating procedure to protect inventory from theft, to include: Locks, Exterior Lighting, Surveillance Cameras, and Alarm System
    Prohibits firearms dealers from hiring an employee who is prohibited from possessing a firearm and requires criminal background checks be conducted on all employees annually, to include finger printing
    Requires a dealer to maintain liability insurance for the acts of another using a firearm sold, rented, transferred by the licensed dealer in the amount of $2 million
    Requires dealers to report the theft of any firearm to law enforcement immediately upon discovering the theft
    During business hours requires:
    Firearms be stored in locking display case or another secure location inaccessible to customers
    Render all firearms displayed to customers inoperable with a trigger lock or another mechanism
    Outside of business hours requires all firearms to be locked in:
    A vault, safe, or reinforced display case with shatterproof glass
    Firearms dealers are already some of the most heavily regulated businesses in Maryland. Senate Bill 816 will not promote safety, but will cause undue burden on lawful businesses, and perhaps drive some out of business.

    craziness 1) liable for how long ?
    2) If the sale was for a regulated gun doesn't this make MD liable ? Dealer only proceeded after authorization from MDSP

    Every dealer in the state needs to show up tomorrow. Even if that means they close for a day. No sale tomorrow is worth allowing this to pass.

    Today’s Senate Judicial Proceedings Committee hearing is underway now.

    The Maryland General Assembly launched a new website design this year.

    There is more bill information on the new livestream page for the Committee hearings.

    The status of each bill scheduled to be heard in that hearing appears in a scrolling column on the right side of the livestream page.

    Bills not yet heard (“pending”) are listed with a DARK GRAY background.

    The bill currently being heard (“Current”) is highlighted in a YELLOW background.

    Bills that have been heard (“Completed”) are highlighted with a LIGHT GRAY background.

    SB 907 was the first bill.

    SB 646, the Firearm Storage bill is now scheduled to be heard fourth (next).

    SB563 and SB570 were inserted into the originally scheduled bill order ahead of the Firearm Storage Bill (SB646).

    SB 816 the Firearm Dealer bill, is scheduled to be the eleventh bill (second to last) heard today.

    This sets an exceedingly dangerous precedent. It could then be applied to people who sell cars, chainsaws, bats etc.

    Amazing that the JPR Chairman admits when the MGA is in a rush to pass anti-gun owner laws that they are only “half-right” in their understanding of the rulings of the Supreme Court, with respect to the Civil Rights the government is instituted to protect.

    Watching the testimony on SB646 (Safe Gun Storage) which is also on the docket today. Sen Cassilly just destroyed the Giffords gal. The safe gun storage act violation would be a 5 year sentence and a $5K fine, he asked her if she would support the same penalties for stealing a gun.

    She just hemmed and hawed and wouldn't answer the question.

    The first panel (the “suits”) were very effective in discussing and answering questions about the facts, the ambiguous bill language and current case law.

    The second panel was very effective in testifying about the reality of home self-defense, in a world where even children can (and do) repel intruders with firearms when home alone.
