    Both of the cases granted today were relisted once, continuing the streak of nothing getting granted without a relist.

    They haven't updated a relisting date, yet. My guess is we'll see it come up again Friday.

    This could go on and on if they are holding for CA-9.

    Well, they did re-list a case 19 times already (not sure if it got re-listed again this week). I suppose they could re-list until their summer recess, and by the time they return in September CA9 should have decided on whether they'll go en banc.

    Well, if SCT is signalling their interest in Drake (and Peruta), they are basically telling the 9th: Deny en banc and let someone appeal, either combine cases for next term, or create a split.

    I think the fact that they have not denied this case and have relisted it is actually excellent news. The "I didn't get time" excuse is far less likely.

    One of the cases they took today was relisted (Yates, limited to Q1).

    This lends significant weight to the theory they are scrutinizing this case as a suitable vehicle, waiting on Peruta, or both.

    can they relist / kick the can down the road 1 to 2 weeks forever or is there an end of session or something where we get a longer wait?

    Though I haven't been able to find their source, in a blog post on this subject TTAG says that the rumor is that Scalia is holding up the cert vote trying to get a winning vote total before the case goes for a cert vote.

    I'm guessing their source is wishful thinking.
