    Mainly negative after probable interpretation and committee cleanup.

    Removes the sunset provision where this expired on July 1, 2012. :tdown:

    Allows "historically significant weapons" to be donated to a 501(c)3 located in DE. :thumbsup:

    Removes the ability of the LEO, under "disposal", sale or transfer to a FFL/collector/importer/manufacturer. :tdown:

    Removes ability of LEO to destroy the firearm. I think the strikethrough was an error on their part and will be corrected to reinsert "or destruction of the firearm". :tdown:

    We all have our feelings on these and I think most say it is a waste of money and destroys good firearms. Some also look at it as an opportunity to "parking lot pick" and move some junk at the program's expense.

    To me this reads as if a retired police officer from another state now residing in DE will be allowed a permit to carry? Sorry, I scanned it quickly, but I thought you may know more.

    (c) As used in this section, the term “qualified retired law enforcement officer” means an individual who:
    (1) separated from service in good standing from service with a public agency as a law enforcement officer;
    (2) before such separation, was authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law, and had statutory powers of arrest or apprehension under section 807(b) of title 10, United States Code (article 7(b) of the Uniform Code of Military Justice);
    (3)a. before such separation, served as a law enforcement officer for an aggregate of 10 years or more; or
    b. separated from service with such agency, after completing any applicable probationary period of such service, due to a service-connected disability, as determined by such agency;
    (4) during the most recent 12-month period, has met, at the expense of the individual, the standards for qualification in firearms training for active law enforcement officers, as determined by the former agency of the individual, the State in which the individual resides or, if the State has not established such standards, either a law enforcement agency within the State in which the individual resides or the standards used by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State;

    They don't need a permit to carry, only LEOSA qualifying ID.

    Also "specifically" adds AMTRAK Police, Federal Reserve Police, and any other Executive Dept official with arrest powers per USC as allowable persons.

    This just clarifies DE's LEOSA law.

    It's been a while since i looked at hunting regs for Delaware. Do they include the Smith 460 at this point? They did have 45 and 454 Casull last I looked. Also, if 460 is excluded, would you be able to hunt deer using 454 Casull loads in a 460 (which will safely fire a 454 Casull).

    edit: Just looked at the regs. They mention 460 Rowland is included since it is 45 caliber. That should, therefore include the 460 Smith since it is also 45 caliber (as is the specifically mentioned 454 Casull).


    Just curious as Delaware is on my short list of states to move to in the next year or 2.
