    This is outstanding. I can't wait to see what the next two weeks bring in the way of litigation. Plus, once the initial salvo is finished for SB281 court filings it will be about time for the SCOTUS to announce cert on Wollard. I can hear Mother Freedom ringing her bell!

    Well written complaint. The longest trip begins with a small step. I did note the economic impact argument but did not see it extended to a possible argument that every one of the regulated weapons that become banned on October 1 will be significantly reduced in value because they can only be sold out of state (or to a retired LEO) -- is this a taking without compensation??

    So what has our NRA dollars gotten us Marylanders? - nothing that I can see. Even after the president of NRA, who lives in Md, said they would file law suit - right!:mad54:

    MSI is where our dollars should go:D

    Obviously you haven't noticed the press releases by AGC to see them thanking the NRA for all the support getting this going. Just because they are not splashed front and center does not mean they are not involved.

    I believe that it also helps our position that they are not in the fore front. No need to detract from the fact that this is a MD battle.

    In MD, the NRA is the great satan. NRA members are mindless out of touch rednecks who are a tiny minority of Maryland residents. They have to stay out of the spotlight.

    But remember; we could have the BEST gun laws in the nation, and if the Fed passes a ban, it impacts us. The NRA is great at the national level.

    I'm not a legal expert by any means, but just reading the brief I could tell they have two specific complaints in this one brief. 1) the undue hardship the law has on Americans with disabilities
    2) the undue hardship this places on Maryland FFL's in relation to those of neighboring states.

    Don't bet on this being the only game in town.

    That was a very interesting read. Surprisingly, despite all of the attention on the HQL, there is no mention of it.

    It'll be a separate suit.

    The way I figure it, we're looking at two major lawsuits here, plus a range of minor ones. The first is against the gun ban. The second is against the HQL.

    This case against the gun ban is good. In particular, they are making a point of keeping the whole affair local - the primary plaintiffs are all in Maryland. And they are bringing up non-2A arguments that allow us to win without new 2A case law being created. Watch for a truckload of amicae on this case.

    The HQL? I'm expecting to have an injunction on that one as of the end of next week, if not considerably sooner. Given the problems the State is having, I expect the only debate on the injunction to be the length - the State will want around 90 days, we will want it until a ruling is made.

    I have serious doubts that we can win outright on the HQL...but we can nibble it to death. MSP creating requirements not in the actual law is one bite. The cost is another bite. The lack of access to fingerprinting outside the I-95 Axis is a third bite.

    Well, unless something has changed recently, the NRA is supposed to match the funds we drum up in aggregate between MSI, MLFDA, and AGC.

    Reading lawsuit now... can't really see how much counts 1-3 will survive...(IMNSHO count 2 could have been a copy/paste job from when the 20+ round mags got banned) but... count 4 is where things got interesting - that's where the vagueness of the whitelist/blacklist is attacked.

    "Strict scrutiny" may be what wins it, though. The law was to prevent gun violence, and... well, if the statistics can be backed up, long guns aren't used in violence much.

    I hope something good comes out of it, but I expect most of it to get thrown out, with lots of "but California does it!" thrown in with the salt just because the administration hates us.

    I am assuming there will be at least one more lawsuit over HQL / handguns.

    I just had a thought - if this ends up at the SC and they rule against a mag ban or AWB, there will be a lot of Democratic legislators angry at O'Malley. If he were smart (I am not saying he is) he would head this one off before it goes too far and ruins it for them.
     
    The NRA-ILA has made claim many times that SB281 has to go into law before a suit can be filed. I wouldn't count the NRA-ILA out just yet. I'm sure the taxing Socialist Oh-Mau-Li is praying that the NRA just ups and goes away. Better get a thicker prayer rug TRAITOR.
