So if Lou's email is correct, can our FFL's then perform their own NICS checks on stripped lower receivers and release on day 8 in good conscience? (ie, to be COMPLETELY compliant with ATF and not fear any repercussions for release to a prohibited person)?

What about regulated long guns?
NICS doesn't know about MD's screwy laws. (At least they didn't til this crap with MSP started.) A long gun is a long gun to NICS. The MD FFL knows it's regulated and knows the procedure for regulated firearms.

8 days was always ok - it's MD law. Federal law does not require a NTN for POC states like MD so there was no issue with federal law either.
Whether your dealer wants to release is another thing entirely, but they can release legally.
