    How about a rider that said if anyone suspected a state legislator of being intoxicated they could demand they take a breathalyser test? And in the event that the legislator failed that they lost their seat and all benefits. Think that would pass?

    I don't drink often, and usually avoid it all together if I expect to be handling or carrying a firearm. That said I would equate carrying while intoxicated to having keys in your pocket while intoxicated; for some people both are a really bad idea. Once again I don't condone carrying a weapon while intoxicated.

    To me a better comparison to driving while intoxicated would be drawing the weapon. A holstered weapon is not going to suddenly discharge any more than a parked car is going to crash in to someone.

    As someone else already mentioned; solution in search of a problem.

    The concept of CCW permit holders engaging in drunken gunfights is an antigunners fantasy. Even in jurisdictions with no explicit restrictions on drinking or being in drinking establishments aren't having problems.

    But with such entrenched "Mad Mother" attitudes even amongst large swaths of gun owners argueing for no regulations is as palitable as arguing for the 4th and 5th Amendment rights of child porn collectors.

    So long as some sort of regulation is a political necessity, it is better to have an objective measurable standard ( ideally same as for driving) , than a vague subjective standard.

    These legislatures are incapable of looking at neighboring states to see if the thing they're worried about is actually any kind of problem.

    So, are they allowed to drink while carrying just not get intoxicated?
