Is it legal for me to purchase magazines online (17rd) and have them shipped to a family member in PA for me to pickup?

Since your purchase is interstate, federal laws apply so it is legal. However, we have found that there are companies that will not sell to you no matter where you want it shipped.

Brownells and AIM Surplus used to do it, I don't know if they still do. Midway will ship to another state and I have used them to ship mags to PA to my brothers house.

IF an out of State friend was to purchase a magazine of any capacity legal in their State and gift it to you when you visit them in their State, THAT would be legal.

In theory, yes. However, most sites will reject your card if billing address is MD.

Could the family member order, and pay for them and you pay them back when you pick them up? That's legal.

It is not illegal as MD laws do not pertain to what you care to purchase on line and have it sent somewhere else. The only agency that has jurisdiction in an internet sale out of state to another state is the DOJ. And exactly what Federal law is it that they will be charging you with? Sending a birthday gift to your brother? :rolleyes:

Some sites will let you send "banned" items to out of state addresses and some won't. It is legal as long as your family member doesn't mail it to you. You have to take possession of it out of state.

I have family in DE and do this regularly as well. Some stores will deny the sale based on the billing address. I've even had one (AIM Surplus) that made me state via email that it will not leave the state I shipped it to.

I usually just go across the freedom line to PA/VA/DE and purchase.

It is no different than you buying mags at a store out of state or at the Chantilly Gun Show or some such venue.

Maryland laws on this only pertain to transactions/transfers in Maryland, and possession is not illegal. You are conducting commerce with an entity out of the state, so this transaction would be perfectly legal.

I think the issue is, what is a "purchase" of a magazine, as that is also illegal while within the state. Even by your standard, that transaction is occurring in MD, isn't it?

The purchase is not taking place in Maryland. The computer just takes the place of an envelope and an order blank. If you send them your order and your money and they send whatever it is to another state, nothing occurred in Maryland. The purchase takes place when they cash your check or money order at their bank.

From what I understand, the purchase, sale, transfer of ownership, or trade of magazines with a capacity >10 rounds is prohibited within state lines.

Transporting over state lines and ownership are not prohibited.

If the website is not collecting MD sales tax, then the transaction is not taking place in MD. If you take possession out of state, then the transfer of ownership is not taking place in MD.

If you want to CYA, place the order from your phone while you are over state lines so there is no gray area whatsoever.

This has always been my take on it. The actual transaction is taking place wherever their server that verifies your cc is, I would think that would be in the state of the business you are buying from. No transaction is taking place in MD

Yes, that's perfectly legal because you received the mag in another state besides Maryland.
