If I receive a replacement handgun (same make and model) under warranty, is there a requirement to register the new serial with the MSP?

There's a Voluntary Registration application but it doesn't seem like it applies (the "desires" postion bothers me):

"The registration of a regulated firearm that is not required by Maryland State statute to be registered in the Maryland Automated Firearms Services System (i.e., Firearm(s) that were legally purchased in another state by an individual who resided in that state who has now established residency in the State of Maryland and moved their estate belongings into the State of Maryland, an individual who possesses regulated firearms or other types of firearms not previously registered in the State of Maryland who desires to register it), or an individual who performed a secondary sale of a regulated firearm in Maryland prior to the Gun Violence Act of 1996 (effective October 1, 1996)."

If they are changing the serial number, they will not send it back to you but to a FFL of your choice. If you sent one and they repaired it, they will usually send it back to you.

As john said...and since a replacement gun is a different gun, the manuf will send it to a ffl in your state and if md, you will need a hql and paperwork to claim your property.

must be a handgun rule. Stoeger replaced my O/U shotgun several years ago and sent it directly to me

Yup. Regulated firearm rule. I have a nice little P3AT that I babied when the plastic frame cracked all the years I didn't have an HQL for that reason. When I gave up my principles and got one, I sent it off for a free replacement.

I sent a handgun back to Walther through an FFL. Walther determined it not repairable and sent me a new handgun. When the handgun arrived I went in, filled out the 77R on the portal and waited the required 7 days.

They made a mistake as it was never registered to you so it should have never been sent to you. The law only allows manufacturers and gun shops to send a modified or repaired gun back to the owner.

I sent a handgun back to Walther for repair which they deemed unrepairable, and they sent me a new gun straight to my house. No FFL involved.

Assuming you are nor a 001 holder, that’s a state violation. I would think of the ‘68 Act also. Unless W using the same numbered chassis for the new gun.
