    Doesn't matter what the law says when they have men with guns willing to enforce what they say. Law only matters if everyone is playing by the rules. Of course they will just make new rules to suit their agenda and therefore in their rationale they are following the law and you are the criminal.

    An EO is just an order by the president to the executive branch instructing them to do a thing.

    It isn't legislation and it cannot order the executive branch to do something that violates law.

    An EO can't ban guns. An EO could tell the ATF to take the strictest possible interpretations of all laws and promulgate stricter regulations that comply with the letter of the law.

    How long were Trump EO's and even Obama EO's held up in litigation? Years for many of them.

    I just keep thinking about DACA - seems if you stop enforcing a law, the courts will let you just throw it away. If only The Donald had done the same with the NFA.

    Well, seeing as the ATF has been known to completely disregard the facts before to go beyond the law (like the recent inability to use a ruler to measure a shotgun's length - albeit rectified reasonably quickly), this could be a Pain.

    Just for a different take on this, should Biden try to EO his gun policy, it will be immediately challenged in the Courts. It is unconstitutional to amend the Bill of Rights by any means other than those outlined in the Constitution. He can try to change CFR, but even this will be challenged. I know for myself, I will not follow any unlawful changes to our 2nd Amendment rights. Semper Fi.
