    Due to the New Jersey shut down, the governor has declared FFL dealers to be non-essential so they will be closed. He has also directed the vendor of the NICS to turn off the ability to submit new requests. Since all gun transfers in New Jersey must have a background check, he has basically halted all gun sales.

    This is the type of thing that Alan Gottlieb and SAF love to challenge in court!

    Unlikely to win. Been a very long, long tradition that your rights, even constitutional ones, can be limited by states of emergency.

    The Second Amendment Foundation today applauded Illinois Gov. J.B. Pritzker for including firearm and ammunition suppliers on the list of “essential businesses and operations” that will remain open during the Prairie State’s “Shelter-In-Place” emergency due to the ongoing COVID-19 Coronavirus emergency.

    “When an anti-gun Democrat governor declares that essential businesses include firearm and ammunition suppliers and retailers for the purposes of safety and security, that is a really big deal,” said SAF founder and Executive Vice President Alan M. Gottlieb. “Every governor should copy the Illinois example when issuing ‘shelter-in-place’ and business closure orders in the face of the Coronavirus.”

    Three other states are already under sweeping emergency orders as the nation copes with the Coronavirus pandemic. They are New York, Pennsylvania, and California.

    “Depending upon how long this emergency continues,” Gottlieb observed, “many Americans may find themselves facing situations where they will need to be their own first responders. Gov. Pritzker obviously understands this, and we encourage the governors of all other states to recognize this isn’t an issue of party politics but of personal and community safety.”

    While certain rights are more limited in states of emergency, not all rights are affected the same way. In an emergency, the need for an individual to protect themselves is increased, while the ability of the government to provide public safety is decreased.

    Exactly. In addition to needing to care for their own loved ones, we're going to see a lot more first responders getting ill/being quarantined, with many of these departments tight on people even before crap like this.

    Since governments have argued successfully that they have no duty to protect you they could argue that their protection has not decreased.

    still pisses me off

    They won against Louisiana (or New Orleans) after Katrina. Don't remember the specifics.

    i was very angry when they confiscated self defense weapons from people trying to protect their homes, even flooded ones from rooftops. I think I read here on MDS or somewhwere where there are still confiscated weapons that have not been returned.

    The government would likely never argue that point.

    It undermines their argument.

    In order for the government to justify restriction on rights they need to demonstrate that the restrictions are substantially related to an important government interest. They typically claim an interest in public safety. If the government takes the position that it does not actually protect the people, then what interest is the government really protecting?
