    Most other constitutional rights don't address public safety the way 2A does. The other rights certainly bend when there is a legitimate impact to public safety.

    No, they don't. The 4th Amendment is implicated by "public safety," and the police don't get free rein to do whatever they want.

    Will the AG’s letter be in consideration this late in the game?

    It just seems like a moot point; the opinion speaks for itself and in no way can be interpreted as an endorsement of may-issue, especially one where no permits are issued.
    It's probably an attempt to gain favor for en banc using the dissent's opinion.

    Wolf would know better than me but I'm not aware that the county/state really made a big deal about only security guards getting OC permits-until now. Even accepting the AG's assertions, they still don't issue permits.

    Here's the docket as of today. On Oct 2nd a 30 day extension was given for our response to the petition for rehearing en banc. That response is now due Nov 8th.

    Great job, Wolf!! And thanks for all you've done for Mr. Young. Really hoping he gets resolution. Still would love to see this case get to the Supreme Court though...a case with the State appealing due to a Statute overturned would be irresistible to the Supreme Court.

    If en banc is denied, Hawaii will have to make some serious decisions on whether to appeal...
