    It's pretty safe to say the 9th circus will write the Constitution on a long piece of string, tie it in knots, and then chop small pieces out of it, gluing it onto a piece of cardboard like that macaroni noodle art they do in 1st grade.

    Damn, that is an angle I never thought would be used to break the Hughes Amendment if it works. Guess I know I am getting a few FA's if it opens the registry.

    Reminds me of the guy who bought the island off the Bay, built a house without permits, was ordered to tear down the "pool house" and 10 years later they will still not give him a permit to tear it down.



    Sounds good but only time will tell. FA sounds like fun ...

    Imho it is a cogent and correct argument. However, judges act stupid with 2A and many of them take the stance of “the greater good. We don’t care if the law violates the constitution”

    Just look at Kavanaugh’s recent argument against over turning enhancements to penalties for being armed during the commission of a crime. He literally said in his dissent that these are bad people and we are going to let them out earlier because of this decisions, F what the constitution says.

    Okay, I may have paraphrased slightly.

    I can't link to it now but he lost at CA9 in a very brief unpublished opinion. There's apparently a case from 1996 (also CA9) called Hunter that killed any chance of him winning.

    He could still appeal en banc or Scotus but I doubt either takes it.
