The question still is if they contacted Fredrick Cnty to do the stop and were told by Fredrick Cnty to go ahead and make it, did Fredrick have the authority to tell Howard Cnty officers to go ahead and make it? Further if the Howard cnty officers are not sworn officers for that jurisdiction were they legally to make that stop? They only way I can see them being allowed to operate like that is they are operating under a signed Mutual Aid MOU that was done before hand between the two counties.
Outside of MOU's Maryland does recognize authority of police officers to act in emergency situations outside of their jurisdiction.
The courts do not expect an officer to witness a felony or violent act and go about your day because they aren't in their county.
There's several other legal ways for this to play out. The surveillance team could have seen them commit a crime in MoCo previously which would give them authority to make an arrest. It's possible MoCo attempted to make the actual stop with a Frederick unit behind them.
My bet is there is a old MOU dating back to the 60's or 70's giving the neighboring jurisdiction authority in certain situations basically copying the state's law regarding the issue.
