HBAR upper manufacture restriction?

I understand the Bushmaster rifle has been banned in MD except for grandfathered purchases already made prior. My question is, does this apply also for a Bushmaster HBAR upper if I utilize a different manufacture lower?

The lower is the rifle. An upper is just parts. If the lower is another manufacturer, that is the brand of the rifle, not Bushmaster.
