    SB 68 - UNINTENDED CONSEQUENCES

    Senate Bill 68 is one of those well-intentioned bills that sounds good until you read it. The purpose of the bill is to protect children from internet advertising that could be "harmful to children".

    We all agree that children should be protected from the "bad guys" on the internet. But this bill, like many others, has unintended consequences.

    If this bill becomes law, NRA Eddie Eagle Gun Safe Programs could become illegal; it could become illegal to market Hunter Education and Hunter Safety programs to anyone under the age of 18; and it could be illegal to market other firearms and hunting related safety programs to anyone under the age of 18 years.

    Today's children learn on the internet - they learn what's right, they learn what's wrong and they learn what is safe and what isn't safe. SB 68 in its current form could, and will, make it impossible to deliver the firearm and hunter safety programs we need for our children to be safe and responsible.

    As good as it may sound, and as well-intended as it may be, SB 68 is a bad bill, in its current form.

    SB 68 will be heard in the Senate Judiciary Committee on Wednesday, May 6, 2015 at 2 pm.

    CALL TO ACTION

    •Call your Senator and politely ask that SB 68 be amended to ensure that our children can receive much needed firearm and hunter safety education programs and information. Ask them to oppose SB 68 until the Second Amendment, educational and safety rights of our children are protected.
    •Call the members of the Senate Judiciary Committee and politely ask that they work closely with the NRA and DSSA to improve this bill and to protect the education and safety, hunting and competitive shooting opportunities for our children. Members of the Senate Judiciary Committee are Senators Henry (D), Blevins (D), Lavelle (R), McDowell (D), Simpson (R) & Townsend (D).

    SB 83 - "Domestic Violence" - Really?

    NO!

    SB 83 has nothing to do with preventing domestic violence and everything to do with infringing upon the right to keep and bear arms.The rabidly anti-gun, Bloomberg inspired and financed "Delaware Coalition Against Gun Violence" is behind this bill. Two of the bill's sponsors, Rep. Barbieri and Rep. Baumbach are on the Board of Directors of that organization - draw your own conclusions.

    SB 83 is simply another Bloomberg-inspired anti-gun measure designed to increase the number of "prohibited persons" and to insert the police into matters where their presence may not be necessary and may actually be counter-productive.

    Ask any Family Law practitioner and they will tell you that as bad as Delaware's current "Prevention From Abuse" (PFA) law may be, it works"just fine" the way it is - SB 83 would just make it worse.

    In fact, those who might be critical of Delaware's PFA law will tell you that if anything, it's the anti-gun bias of some Family Court Judges and Commissioners that need fixing, not the law.

    SB 83 contains very serious "Due Process" issues including (1) the removal of the express prohibition against "ex parte" Orders where the gun owner is not present serving as the basis for prosecution as a "prohibited person"; (2) making new prohibitions on gun/ammunition ownership "effective immediately"; (3) adding ammunition to the list of prohibited items; (4) requiring immediate relinquishment of firearms/ammunition to police without an opportunity for a hearing; andthat's but a few, (5) the list of "horribles" goes on and on and on.....

    SB 83 contains nothing that will actually protect women (or anyone else) from acts of domestic violence but, instead, contains many new provisions designed (1) to make criminals out of otherwise law-abiding gun owners and (2) deprive citizens of their property without compensation and without due process of law.

    SB 83 also (1) inserts our over-worked and under-appreciated police into the process where they have never been before, placing undue burdens on already over-worked and under-staffed agencies interfering with "real police work"; (2) making the agencies responsible for the security, protection and storage of sometimes highly valuable and collectible privately owned firearms and the safe storage of ammunition - and then seems to allow police agencies to destroy the firearms after the case is over rather requiring them to return the firearms and ammunition the same condition as received - (3) how many law suits against Delaware's police officers and agencies and against Delaware's towns, cities and counties for mishandling, losing and abusing private property? (4) Who is going to pay that bill?

    SB 83 is a bad bill based upon bad policy presented for bad, anti-gun reasons having nothing to do with the commendable goal of preventing domestic violence.

    CALL TO ACTION

    SB 83 has been assigned to the Senate Judiciary Committee
    •Call your Senator and politely ask that SB 83 be defeated. Tell them that SB 83 has too many technical and Due Process flaws to actually work.
    •Call the members of the Senate Judiciary Committee and politely ask that they work closely with the NRA and DSSA to improve this bill and to address the real flaws and issues contained in our current PFA law. Members of the Senate Judiciary Committee are Senators Henry (D), Blevins (D), Lavelle (R), McDowell (D), Simpson (R) & Townsend (D).

    Missed this one.

    House vote TODAY, 5/12/15. (passed 40-0, off to Sen Jud Com)

    Removes "Violent Misdemeanors" as a potential disqualifier from future firearms ownership with stipulations. This is sponsored by anti's. Haven't had time to research this one yet. (Gave it a thumbs up)

    Updated SB68, SB83, SB147, HB192.

    Added HB201, HB217.

    HB192/201 does allow for a person with a CDW Permit to carry where permissible. DE is an OC state. These bills eliminate OC as permissible in said designated areas.

    HB217 looks to me to be the beginning of DE laying the foundation of a spent shell casing program.

    (b) Whenever a law enforcement agency recovers any spent shell casing at a crime scene or has reason to believe that the recovered spent shell casing is related to or associated with the commission of a crime or the unlawful discharge of a firearm

    (c)..."shall develop and promulgate a statewide standard protocol for the recovery and forensic processing of firearms and firearm related evidence where such firearm was unlawfully possessed, used for any unlawful purpose, recovered from the scene of a crime, or reasonably believed to have been used or associated with the commission of a crime"

    Some should point them to the md general assembly's site on the shell casing bill. When NY, CA, and now MD ended it, it's probably not a good idea lol
