Mr. Bowen is trying to apply how the MSP applies the law to how the board should interpret the law. Absolutely wrong approach.

Wow. Great to have your insight during the meeting. I thought that this was supposed to be a citizen review panel, not a second bite of the apple for MSP or the state.

I doubt it, but maybe? The Court will give deference to the Board unless there was an error of law. Here the Board just had a different opinion based on the facts versus the designee of the Superintendent. Besides, the Super as the client would (or should) have to authorize the petition for judicial review. That would be interesting!
