    Are there any cases attempting to strike down the Tax stamp requirements for NFA guns/silencers in light of the 2A getting the same protections as the 1A? As I understand it, the ink tax in MN case would be similar and that tax on ink and paper was ruled an unconstitutional infringement on free speech. So wouldn't the excise tax on guns, ammo and NFA items also be unconstitutional?

    No cases yet, but everyone agrees some are coming. The big steps right now are squaring away the right in the first place. We still don't have that one neatly wrapped. We got the tools, but work remains.

    I don't think NFA is going down in the Courts. I outlined the reasons elsewhere, but even Scalia suggested the same by reference. We'll need to have Congress fix that one.

    Taxes on the core ingredients of the right (excise, etc.) are all up for grabs. So too "registration" and "permit" fees.

    The first to get challenged will be permitting and registration fees, requirements and timelines. Right now all the challenges are on the actual requirements themselves ("good and substantial", etc.) with a slight reference to expediency (timelines). Feet dragging will be challenged next (one year permit processing and onerous steps), followed by registration and permit fees. I don't see them surviving under the strictest of standards, where 2A is viewed like voting. But some arguments exist to keep them alive as long as they are low cost. There is a chance that an argument in favor of carry-permit fees could succeed even under a strict interpretation. I think it'll depend on the mood of the court.

    I suspect excise taxes will be challenged eventually, but not import taxes or import restrictions. Those are almost surely legit.

    People need to be more precise in saying what they mean. Do they mean taking down the entire NFA or do they mean striking down 922(o). I would be perfectly happy if 922(o) was struck down.

    Cross motions for summary judgment filed against each other. Senior Judge Walker David Miller has the stuff that's been filed as of July 19. I am not sure how long he is going to take to write up the ruling. Been told that MSJ's take anywhere from 3 to 6 months to write up something.

    Can you RECAP Document 17 of the Baker case please? Need to see what stipulation they are talking about.

    Scalia specifically mentioned machines guns (922(o)). There are other posts on the net talking about the entire NFA "being unconstitutional", but a good number of scholars say "no".

    All parties in the case challenging the possession and discharge of firearms for self-defense in Nevada State Parks, Baker v. Drozdoff et al (former Baker v. Biaggi et al), have agreed to a preliminary injunction in the case. This injunction prevents the enforcement of Nevada Administrative Code Sec. 407.105(1)(b) - (c) which prohibits the possession of a loaded firearm unless one had a recognized concealed carry permit as well as the discharge of any weapon. Nevada has 60 days in which to start an administrative rule-making procedure to amend this code to remove language that abridges the right to keep and bear arms.

    Low hanging fruit, but a victory regardless...

    It sure would be nice if MD and SAF would come to such an agreement. I'll go back to the world of unicorns and gnomes now...

    It is heartwarming to see so many cases in the legal system to win back gun rights. Also, it keeps drawing me to the thought that our rights are far more reliably won in the courts than trying to elect a professional liar (politician) and hoping he goes against his nature and keeps his word.
