    Board votes 3-0 to overturn MSP on 2nd applicant. On the first one, board voted 3-0 to uphold the denial (Closed session).

    Third applicant up.

    The cardiac surgeon case is somewhat of a replay. I remember the Board reading the MSP position, verbatim, into the record at a prior meeting, and then for some reason they stopped to schedule an in person hearing which seems to be happening now.

    1. The MSP testimony about the alleged general hospital “policy” at Sinai is hearsay, and beyond that MSP has not shown that such policy, if any, would control over whatever separate agreement for privileges, etc., that the physician has directly with the hospital. Further, MSP has not shown that the physician could not obtain a waiver of any such alleged policy. There also is no testimony or evidence that hospital "policy" is controlling under Maryland law; this is merely an unsupported assertion by MSP.

    2. It is not a question whether the doctor actually has narcotics, but whether he is perceived by potential attackers to have them.

    3. Particularly for a cardiac surgeon, waiting for a security escort on the way into the operating room is a ludicrous proposition.

    Listening to MSP, I just laughed recalling all the Pallozzi will fix everything talk...

    So there were just 3 cases heard tonight? Two of the cases, one was a boat captain (approved), and the other was the chief cardiac surgeon of a hospital and he was denied; did I hear this right?

    Any idea of the grounds of the first case, does it appear anything is changing, or pretty much still status quo?

    The surgeons case was very disappointing. Two board members stepped up and basically said "carry rights for me but not for thee" despite enough similarity to prior cases that it would have been an easy one to overturn. I personally feel less safe as a Maryland citizen tonight knowing that he is walking around the city unarmed with his narcotic prescription pads.
