    Risky. Lack of notice would be something the State could complain about on appeal.. Better to do it the right way with a motion. And those you file only with the right preparation and fully supported.

    Given that this was a hearing on a motion to dismiss, it's a pretty simple decision I would think.

    I have no idea what's going on. It may only be that the judge is busy with other matters. In federal court, criminal matters get a preference.

    MSI and the other plaintiffs won almost everything on the State's motion to dismiss in an order issued today by Judge Garbis. Announcement and details and a copy of the opinion will be posted shortly on MSI's website.
