    Ok, I attended the Citizens Council meeting and the guest speaker was a detective from the domestic abuse section. He gave an overview of the law and how AA county would handle removal of firearms in such an instance. He tried to assure folks that they would do due diligence to make sure this wasn't a he said she said situation before they did anything. Additionally, he indicated that, unless there were extenuating circumstances (Previous violent history, immediate danger to someone etc.) then they were going to try and work with the person to get them to surrender their firearms. He indicated that they had done 7 or 8 of these and all of the people were cooperative.

    There were many questions from the folks in the audience most of the "what if" kind to which the officer could only respond "yes it is possible" kind of answer. He was adamant that the order to surrender did not allow a search of the premises as the individual was not under arrest. He also stated that they do not want to damage anyone's firearms as they would be responsible for damages. (I know from personal experience that guns, cars, airplanes etc., if taken as evidence, are not maintained so this was kind of a different attitude. I guess only time will tell if things will work this way.

    Again, this talk was strictly about how AA county will be handling Red Flag cases. Since it is new to our area, there isn't a lot of history.

    No one towed my car or tapped me on the shoulder and asked me to stand up so I guess I got away clean. :D

    The Southern District Captain made a little speech basically affirming what the detective had said.

    The acoustics suck in their squad room so I probably missed some stuff. All in all, it was worth going to.

    No one towed my car or tapped me on the shoulder and asked me to stand up so I guess I got away clean. :D

    They appreciate that you maintain your vehicle and its registration and also allowed them to scan your license plate in the parking lot. Their men will be with you shortly. :lol2:

    Wasn't it in AA Co where the one fatality occurred from the serving of a ERPO?

    How about the process, what type of receipt is provided? Do they only take the firearms owned by the individual? I can’t understand how they could be trusted, they have no right to check an FFL03 bound book, so how would they know who’s guns are who’s.

    Too many gray areas for this law.

    How about the process, what type of receipt is provided? Do they only take the firearms owned by the individual? I can’t understand how they could be trusted, they have no right to check an FFL03 bound book, so how would they know who’s guns are who’s.

    I absolutely positively guarantee you that if a red flag order is served at an address where the respondent lives, every single firearm, air gun, bow and large bladed knife will be removed from the property regardless of who it belongs to.

    There is NO WAY IN HELL cops aren’t going to steal ... excuse me... seize the guns belonging to one resident of the home while leaving the ones belonging to the other residents.

    They will steal.... excuse me again... seize, every weapon at the address.

    There is NO WAY IN HELL cops aren’t going to steal ... excuse me... seize the guns belonging to one resident of the home while leaving the ones belonging to the other residents.

    They will steal.... excuse me again... seize, every weapon at the address.

    Many times, the word they seem to use is "recover" as in "Officers recovered 16 long guns and 15 handguns from the scene." How can they recover something they never had possession of in the first place?

    Maybe you guys should go over to the Southern District and ask your questions. The detective in charge of the program said he is in his office during the week and would be happy to answer questions.

    Because if the public heard "took, seized, confiscated, ect) they'd realize what is happening.

    That was my first thought, 1 out of 7 losing their life over a thought crime. yikes. Didn't someone post some numbers on ERPOs in maybe January, IIRC 119 served in AACO since inception, so I am guessing this is a South County District number.

    Given the intent of this "thought crime" law if anything bad were to take place after one is served and the object used was found to have "not been confiscated" well, that would make any Dept. look bad ... and possibly held liable?? So, I would believe/guess there would be nothing left to defend one's self, I mean cause harm to another, after an ERPO is served.


    It really makes one wonder why, if a person is deemed so dangerous that they may resort to shooting another, they are left on the street bumping elbows with our families, and thanks to John we now know there are SIX (6) out there, at least in South County.
    On the other hand, people have not been tried but have been found guilty (of possibly having a bad thought) and stripped of God given rights.
