I guess I was unrealistic in thinking that justice would be done!
More lawsuits, creating more splits will be necessary. The one off bad opinions just aren't enough for SCOTUS' involvement. We're on our way though, if Peruta becomes cemented. It'll be difficult for the court to avoid the situation where a huge chunk of the states live under a vastly different 2A than the rest(may issue unconstitutional in CA9 but constitutional on the east coast).
I don't know why you guys are so anxious to push this before SCOTUS. I am scared to death that it will ruin the CCW push already going on. Heller and MacDonald were already 5:4 decisions, and I question whether the same justices have the balls to uphold the Constitution with regard to "bear". It only takes one to back off due to political pressure and I don't know if all five have the guts to do what's right.
If just one justice wavers in this Drake case, the antis will make this case their war-cry like we did with Heller, and you can guarantee some major reversals in the fight for CCW.

If SCOTUS doesn't pick up Drake (or something like it) this session, then I'd like to see a Congress step up and settle this. Heller says its a right, so the congress can reign supreme over state law. Let Maryland sue the feds for forcing shall-issue. Let them demand the answer to the Heller/bearing in public question.
My opinion: let the SC deny bearing in public. The Left will gloat, "we told you so." Our side will issue a war cry, and it will be louder, more concentrated and more effective: we are going to push like mad for the legislative fixes we need nationwide. The Congress would not be able to avoid us, or ignore our demands. They would have no excuse for inaction anymore.
