Upon issuance of an ex parte order or long-term order, the court shall order the respondent to surrender all firearms and ammunition that the respondent possesses or owns, in or affecting interstate commerce, as well as any permit authorizing the respondent to purchase or possess firearms (including a concealed carry permit)

At least the standard is "Clear and Convincing Evidence", not preponderance as in the MD bill. It still needs civil,, rather than criminal, penalties for false claims.

And the whole Ex Parte thing really bothers me. I can understand needing to move quickly in some rare circumstances, but this bill normalizes the "seize first and return whenever we get around to it after you've paid $25k for an attorney" mentality. If an Ex Parte hearing is necessary, the court should be required to appoint an advocate for the respondent who can challenge evidence in the respondent's absence. Without that, I can't understand how it withstands Heller as enumerated right, especially in the home.

ERPO-Even Republicans Piss On gun owners these days.

Or maybe it should be retitled the Republicans Determined to Throw Away Any Remaining Chance of Keeping the Congressional Majority Act. It's unbelievable how good these people are at snatching defeat from the jaws of victory.

Glad to see that voting republican, giving them a majority in Congress and the White House, has given us more gun control than 8 years of Obama. Really makes the whole process seem worth it right?
