What I don't understand is that based on SB281, we all have to register our weapons. However, it has previously been established that felons do not need to register their weapons bc that would be self-incrimination.

So can someone clarify if that is indeed the case.

    Slightly confused here....
A felon is committing a crime just by having a gun. Why would they care about registration?

The felon wouldn't. However if the felon was arrested, and then found with a weapon that needed to be registered, then he would face additional charges.

However, apparently some slick lawyer in the past argued that a felon registering a weapon is the equivalent of self-incrimination. So some court (this is what I'm hazy on) agreed with that twisted bit of logic and dropped the charges.

So can anyone fill in the gaps and tell me if that is indeed true or just an urban firearm myth?

Um.. Remember.. If you used ffl in md.. It's already considered registered. ;)

that's assuming the rifle you bought as a non-regulated long gun isn't instantly transformed into an assault weapon in this law...

And by an 8-1 decision the Supreme Court agreed with Haynes that expecting him to register his short barreled shotgun when he was a convicted felon effectively violated his 5th Amendment rights against self-incrimination.

I think we all need to stand together and not register crap. THats the beginning. Once you register and the Communist party stage more murders then will be confiscation.Make them go door to door. If this crap passes pretty much aren't going to be buying anything except a single shot 22. !!! The Communists are Comming,The Communists are Comming!!!

It's not twisted logic, it's the constitution. It was the supreme court in the case that overturned the original nfa. The name escapes me right now.

This is true, LE can already tell if you have handguns or ARs/AKs by consulting their database. Which is why this is a pointless law, LE already knows who they are dealing with, those who support this are either ignorant of this fact or want to intentionally burden firearms owners with unconstitutional fees and taxes to exercise their 2A rights.

except for unregulated weapons like certain long guns. there is no great 'list' of firearms you own. for example, unless purchased on an 03 FFL they cant look up Jon Smith and say oh yea he has 3 K98s, an M1 garand, and a few black powders.

regulated and NFA are completely different stories.

not entirely true. information like this is very sensitive. no officer can pull up your guns on his KDT on his way to a call. its investigative stuff, IE not your average day, and cant be accessed on a whim like we all think.

The OP is confused about what went on with that ruling.

The issue was not "he would be a felon if he didn't register". It was "he was a felon, so he couldn't register without revealing he had broken the law". If you can legally own the regulated guns you have today, that ruling doesn't apply to you. But if you're a felon who's illegally holding on to an AR-15, no, the state probably couldn't make the "you didn't register" charge stick if you appealed.

So, basically, you are on the hook to register your stuff.
