    Just had someone ask if they could drive to PA or VA and buy an AR to bring back.
    I just didn't have a definite answer for them, any help ?

    If the purchase is legal in both states AND they can find an out-of-state FFL willing to sell an AR15 to a MD resident.

    Probably have better luck with PA dealer.

    It has to be HBAR and not meet the MD definition of banned weapon by features.

    Yes you can . But with a couple of caveats .

    The rifle in question must be Maryland Complient .

    Some FFL actively seek patronage of Maryland residents , will be familiar with Md's fine print of legality , and make a point of stocking Md Legal firearms .

    Particularly once you get farther from the border , chances of encountering a dealer that only stocks " generic Free America " version AR , and not comfortable selling anything vaguely EBR- ish to Marylanders .

    Heck many will not sell ANYTHING to MD resident due to not wanting to run foul of our stupid laws.

    Just to clarify, you can purchase an unregulated long arm (MD compliant) at an out of state FFL and take possession and transport back across state lines? Is this the same for a private sale or does it have to go through an FFL out of state? I’m guessing having a C&R would make that easier...

    Yes, long guns are good to go after you pass NICS and meet all of the requirements on MD legal to own list.

    Private sell across state lines needs FFL in either state.

    If its on the C&R list, you having a FFL03 C&R would make getting it much easier.

    Since the changes with FOPA86, the transfer could occur at an FFL in a 3rd state. :)

    But you are correct, in accordance with Federal law, private sales of firearms, between residents of different states, MUST go through an FFL.

    And for funnsies if it is a handgun, it must be through an FFL in the state of the person receiving the handgun.

    Long guns are at/through any FFL.

    Private sales are only legal between residents of the same state (so long as the sale doesn’t run afoul of state laws).

    A C&R would help, but you’d need to find a 1970 or older AR-15 and it would STILL require being an HBAR.

    And if you look at the ATF language for C&R sales, if there are any major changes to the firearm, no matter the age of the firearm itself (unless the changes are 50+ years in the past) it no longer qualifies as a curio or relic.

    They are pretty explicit. Changing sights would be fine. Something like a different barrel or upper that is not original or at least period correct is going to disqualify it as being a legitimate C&R firearm. You could change it after acquisition. But then it wouldn’t be a legal purchase for you as a Maryland resident...

    Federal law and regulation is pretty clear. You can only purchase firearms that are legal in your state of residence. So you couldn’t buy a 1967 AR-15, swap on an HBAR upper and bring it in to Maryland if you were a Maryland resident. That 1967 AR-15 wouldn’t have been legal for a Maryland resident to purchase (Colt HBAR Sporter started being made in the 1980s).
