NRA is not taking position. Talking about two days to dispose. Federal law says prohibited at gavel. State law is contrary to federal. Could get a 5th amendment issue. Would be admitting to law enforcement you are breaking federal law.

Mark Pennak using the expertise 33 years as a DOJ lawyer provides to expand upon Shannon's point.

John Josselyn essentially saying "Ditto", though adds that the fiscal note indicates a massive financial burden. Bill needs more time.

MSI say lots of case law. Would be fellon in possession. It's not just avoiding possession. Constructive possession is an issue as well.
JJ says will require staff and cost millions. Bill not ready.

Vallario asking Mark Pennak about the logistics of HB1424. Forgive me for being slow on Mark's legal arguments and not translating them here.

Mark mentions that the third party must not be someone who can provide immediate access to the firearm(s) from the DQ'd person.

Vallerio talking about how it works. Still unclear how to dispose. Questions dancing around this issue. Law is possession, not transfer. Valerio talking about current law does not allow someone to transfer a gun for you without a background check. Go Vallerio!
