    Odd question, but how does a state end up on the ATF’s permanent Brady permit list? Do they have to request it?

    On the surface, it seems only a background investigation equivalent to a NICS check is required...

    In that case why isn’t an HQL sufficient for MD (assume the 77R is the issue for pistols)? Or in DC a registration card (provided you are using the MPD FFL)? Conversely, Hawaii is on the list, but I can’t imagine them asking the ATF for anything that would make a purchase easier for their subjects.

    EDIT: I should have posted what I was asking about since us slave state subjects are not familiar with the luxuries free America has to offer. In some states with a CCW permit issued by that state, you do not have to go through NICS when making a purchase. Brings new meaning to cash and carry.

    Wv carry permit is acceptable in lue of nics check if it’s after June (I believe) of 2014 they only last 5 years so any current WV carry permit exempts you. You still fill out the 4473 and the dealer makes a copy of your permit.

    In NC concealed carry is used instead of NICS check for all over the counter transfers. Fill out the form, give a copy of your permit and DL and your done.

    Under the Federal legislation establishing NICS , there was provision for States to get waiver if their State based Background Check system met certain standards , oversimplified as being as strick or stricter than NICS .

    This thread is discussing the fine print of that .

    This list shows which states bypass a background check (NICS's, or State) for it's citizen's who already hold a valid carry permit from their state.

    Delaware should be on that list as well. Since DE approved UBC's a few years ago, face to face transfers require a background check, unless the buyer has a DE CCDW permit.
