    If you’re militia, you can bear arms

    The Dec. 19 article, ‘‘Candidate’s gun giveaway is loaded with meaning,” about Peter James was very interesting. Mr. James spouts the National Rifle Association line when it comes to the 2nd Amendment to our Constitution.

    He is quoted as saying, ‘‘The 2nd Amendment grants us the right to bear arms ....” The 2nd Amendment says, ‘‘A well-regulated militia, being necessary to the security of a free State, the right of the people to keep and bear arms, shall not be infringed.”

    When the NRA quotes the 2nd Amendment, it usually neglects to include the opening phrase of that amendment. As a candidate for political office, Mr. James should know that the Supreme Court decided this issue in 1939, ruling that the term ‘‘a well-regulated militia” means a state-regulated militia. The 2nd Amendment clearly does not give every American the right to bear arms.

    The current Supreme Court probably will reverse the 1939 decision when it decides the issue of Washington, D.C.’s law on gun ownership and sales. The majority of the Supreme Court justices today are Republican appointees. The NRA pretty much controls the Republican Party so we can just about predict what the court decision will be with respect to D.C.’s gun law.
