    The judge basically used rational basis dressed up as intermediate scrutiny. She finds that the law is aimed at keeping firearms out of the hands of mentally ill and criminals, so it's fine to throw the other 99.9999 percent under the bus because some bad apple "might" get through.

    A big stumbling block for many states is there is no require mt for no admission to a mental health facility for the previous 5 years. Most states don't require 5 years admission free.

    The real stickler is VOLUNTARY admissions to a mental health facility. Illinois considers that a disqualifier for firearms possession for 5 years. Most states only care about INVOLUNTARY mental health admissions.

    It's also worth noting Trump has just gotten Amy Barrett onto the 7th circuit and has THREE more open vacancies (Michael Brennan has also been nominated, should be confirmed soon). So 4 out of the 11 regular judges will be Trump nominees, depending on how fast they move on confirmation. I expect this to go back to the original panel, but a new judge has to replace Posner. They will likely be the deciding vote since the other 2 judges were split.
