    More ATF Reclassification: Fostech Origin SBV Now NFA Regulated

    Pursuant to an ATF determination earlier this summer, the FosTech Origin SBV firearm now falls under the purview of the National Firearms Act (NFA). The Origin SBV is equipped with a smooth bore barrel that is less than 18” in length, but utilizes a pistol stabilizing brace instead of a shoulder stock. The setup, once believed to avoid NFA regulations, has been reclassified as either a Short Barreled Shotgun (SBS) or an Any Other Weapon (AOW) requiring an NFA registration and transfer application and taxes.

    only if they refuse to follow the suggestions the friendly ATF people put in the letter on that link.

    I don't believe so. I will say that I think shotguns that have been using a brace to get themselves over the 26" mark are going to be banned..

    Back in the middle of 2019, Black Aces Tactical was essentially told by the NFA branch that their folding-braced "not-SBS" shotguns were either:
    1. SBSes, because the braces were really intended for use as stocks (which, let's face it, they were), OR
    2. AOWs, because for AOW purposes, you measure in the shortest configuration.

    This seems to be the same situation. There has been some... speculation? that braces in general are going to get another clarification letter, possibly one which states that braces that are otherwise unnecessary don't count towards OAL. It has certainly not escaped the ATF's notice that they are 99.99% of the time being used as stocks. The most recent SBA braces weren't even run by FATD, which makes them very vulnerable to reclassification.

    We got an email from Fostech last week requesting that we send our SBV back and they will replace it with a Fostech Origin 12 shotgun , Makes you wonder what other items they will go after .
