    Truly ridiculous. If they want to run a shelter on PRIVATE property, of course they can ask visitors all they want, and forbid entry entirely, or lay out conditions for entering the property. But if it's NOT private property, they don't get to have their way. I was particularly amused by this line right out of the opening in the complaint:

    It is essential that shelter staff be allowed to protect themselves and their residents by exercising their professional judgment about how best to respond in such situations, whether by investigating, asking the person to remove the gun from the premises, or calling the police.

    Notice they don't include "actually defending ourselves" as one of those possible responses. Because, you know, dangerous people are always willing to wait a few minutes for dispatch and police arrival before they carry on with whatever violence they are about to commit. And, of course, it's perfectly OK to be violent with a pocket knife or a table leg or with a punch to the throat - just not with guns, dammit.

    This is just them trying to Bloomberg's camel toe under the tent.

    I am not sure about the first amendment angle. I dont see how its a content based speech restriction. A+ for creativity though.

    At the same time if its truly their property its their rules, or at least it should be. Unfortunately, the federal constitution is not very protective of private property rights. Especially when it comes to state law. Seems to me the best analogy here is an easement on private property. In theory its a taking, but good luck with that argument I think its a non-starter.

    This lawsuit has all the markings of a high-profile Windmill Quest - they are filing it to get attention to show that they are "doing something" and raise funds off it.

    They're pretending that shelters for domestic violence victims are a place that would be safer if even their parking lots were an Official Gun Free Zone, and they think that the WV statute preventing them from asking people if they have guns in their cars is a violation of the 1A.

    In other words, it's an absurd construction designed to show that the NRA likes to beat women. Or something.

    I thought it would be a violation of the 5th for the person asked. Don't felons already have that defense? They aren't even breaking the law. How absurd.

    When is SCOTUS going to say what “shall not be infringed” means? Seem like that is pretty self explanatory but it has not been challenged that I know of.

    Why hasn't anyone counter sued for them being discriminatory against men? Men are victims of domestic violence too.

    And if the Boy Scouts can be forced to accept girls, then a DV shelter should be forced to accept men.

    The 2A is a restriction on government, not on private property owners. Freedom means: Private property owners should be allowed the freedom to make their own decisions, even if we think that they are stupid. When the government starts telling private property owners how to use their property, thats essentially socialism. Here the WV legislature told some private property owners that they had to allow people on their property with guns. This law is not upholding the 2A, its the government infringing on private property.

    After today's decisions about gerrymandering and asking people if they are citizens while completing the census I don't get a warm fuzzy feeling about them making a grand pronouncement on the 2A...Roberts appears to be the new Kennedy and may just decide that the 2A is only meant for militias....

    When the Government tells private property owners how to use their property, that is facism.

    When the Government tells private property owners that it now owns (or will use) their property, that is socialism.

    The government has been telling people what they can and cannot do with their private property for a long time....HOAs come to mind...Sure the HOA itself isn't the government...but the court that will uphold their rules most certainly is...And go ask a farmer why they are forced to plant ground cover crops in certain parts of their farm fields...or the person who owns hundreds of acres of swamp why they cannot develop their own land
    because it's considered a wetland...and yet still have to pay property tax on land that is essentially worthless...I could cite examples all night but I think you get the idea...Yep, it's socialism and it's not going away...

    I would say that this suit surprises me...but the harpies of Everytown and Mom's demand action no longer surprise me...they are using their status as mothers to manipulate leftwing politicians, vowing to remove them from office if they don't comply...proving the politicians, especially those on the left care way more about their own position of power than the rights of citizens...EXACTLY the same way they put illegal immigrants over American citizens...
