    So dumb ole me started a discussion on FB about how we don't need more gun laws. One of my family member brought up that there is NO background check required to buy at a gun show in North Carolina. I find that hard to believe and I am looking for someone in NC to verify that for me. Shotgun Joe perhaps?

    Check out Arizona too. Saw a show last weekend where a “journalist” and a firearms enthusiast/instructor went to gun shows & bought 3 handguns, met a guy in a parking lot & bought an AK, then went to a private residence & bought a 50 BMG sniper rifle. All legal in Arizona, zero questions asked. I thought that was strange, that there was zero paperwork. Not sure how I feel about that. For me, it would be awesome, but then I’m not a scumbag criminal.

    In Virginia, secondary sales are face-to-face. Guns hows, cat shows, your sidewalk, anywhere.

    80% of criminals get their guns from friends and family (aka straw purchases) or theft (Source: DOJ study). Maryland has extensive background checks and a waiting period, we are top 5 in murder. We passed more checks including a permit to purchase in 2013 and homicide went up 35%

    In fact, 51% of the names in NICS are there for unlawful (illegal) immigration*. Maybe we dont need NICS, maybe we need a wall?? I am not advocating a wall, my point is if you favor one you should favor the other.

    *Another 20% ish for nonviolent drug offenses. Many states dont report mental health prohibited to the Feds.

    Secondary sales are totally different for a lot of the country vs MD. Any ffl is going to go through the proper paperwork gun show or not. I just sold a pistol here in a sheetz parking lot. Had the buyer sign a letter stating he wasn't a prohibited person and snapped a pic of his driver's liscense. Been here a year now and my BGO symptoms are a thing of the past.

    She just said "gun show". I am assuming this means secondary sale as I am pretty sure ANY FFL will run a NICS just to make sure their butt is covered.

    sounds like the so-called 'gun show loophole.' private sales between individuals of the same state, without a background check, are allowed at gunshows, but also pretty much anywhere else (sheetz parking lot, police station lot, your house or theirs, etc). by calling it a loophole, the anti's make it sound like anyone and everyone can walk into a gunshow and buy a gun with no background check, which of course isn't true. sure there are a few folks who carry around guns for sale but the vast majority of transactions, at least from the shows i've been to, are between ffl's and individuals and background checks are done.

    1. ffl's will run nics checks as those are req'd by law.
    2. have her show you the regs that allow gunshow sales without background checks. all these loose (and outright dead wrong) 'facts' being bandied about.

    Whenever I have bought anything at a gun show (not a private sale in the parking lot) here in Raleigh, I have had to go thru the NICS check. But then, that damn boating accident.

    Some states don't require a NICS check for FTF sales between residents of the same state. VA is one.

    But it's not a loophole. It's the law as written.

    Same laws apply at a gun show as anywhere else in that state .

    In NC any sale of Handgun , even private , requires the buyer either have a NC CCW or a purchase permit from their local Sheriff .

    Hi, OP. I established NC residency earlier this year and BigFoot nails it: NO WAY any licensed dealer is going to transact a sale without buyer producing either a NC CHP or “pistol purchase permit” obtained from buyers Sheriff AND THEN A!SO the Federal form and NICS check.
    ON TOP OF THAT, I have yet to see or hear about ANY private transaction (I.e., gun show parking lot FTF’s, etc.) where the seller did not require seeing buyers NC CHP prior to sale and, even though I only established residency here earlier this year I’ve actually owned property and spent gobs of time here since ‘14.
    So, you can call “bs” on family-member-in-question’s “assertion.”

    Funny how to some people, everything that isn't dictated by the government as to how, when, and where it is to be done is a "loophole."

    Private Sales

    If the Government was serious about implementing NICS background checks for private sales, they could do it easily.

    There are a number of different ways to set up FREE and EASY background checks for private sellers. They could use a smart phone and easily keep a record of the transaction as FFL dealers do.

    There is no will to make anything about guns easy. Socialists have whittled away at the second amendment for decades and have no interest in reducing gin-related violence in schools or anywhere else!
