I'm sure that Dick's will make the proper political donations to the right Democrat politicians, so that this silly misunderstanding is swept under the rug, and no charges are filed.

Oh of course. The state will stick it to the customer and let the store off the hook. Remember when that news anchor brought a loaded 30rd PMAG onto the set in DC a few years ago?

No it is not but the DA would look really, really bad and I would be expecting Dick's to pay for my defense.

In general you're correct, but there are "exceptions", like the kinds of things protegeV was saying.

I was thinking in terms of traffic violations too. Let's say a road crew put up a no left turn sign at a one way street where they were supposed to put up a no right turn sign. TECHNICALLY it would be illegal to make a right turn onto the one way street but could someone really be charged ? Just like the gun dealio, how would they know ?

I was in bass pro years ago (before fsa) and they had butler creek 25rd 10/22 mags on the shelf.

I, of course, channeled my inner Frosh and informed them of their mistake and berated them for potentially selling murderous assault clips that exceed MD state limits.

Yeah, thats exactly what happened... I definitely didnt buy the two they had available. No way...

True, but with the number of laws out there, no one can know them all.

Imagine if you bought your kid a fish at the pet store that was illegal in the US bc lf a distributor mixup, but you had no idea.

Or you bought a pair of knockoff jeans made in a sweatshop, but you were none the wiser.

Are any of those really the consumer's fault?
I mean from a common sense standpoint, not a strict legal one.

Even from a strict legal stand point, a lot of the laws say thing like "knowingly purchase" "knowingly receive", etc. some laws have mens rea built right in to them. A number of others are common sense mens rea where no jury would convict you or nothing but the worst of the worst DA would prosecute you.

example, receiving stolen property. If you really didn't know, you can't or won't be convicted of receiving stolen property.

You'll still be punished, because the state is going to seize the property from you and take up your time with questions and possibly having to testify. You just won't go to prison or have a conviction on your record.

I'd assume they'd likely just seize the magazines and make you make a deposition for criminal/civil penalities against the corporation.

Just went back up to the bel air dicks. Apparently another dicks store saw this thread and called the bel air store up and told them to remove them. They only had one left by the time I got there so one of you must have cleaned them out LOL!

I find it hard to believe that any of the fine, upstanding, law abiding members here would do such a thing. :innocent0

I stopped in at dicks this morning to get some 9mm and they were selling 15rd glock19 pmags. If a retailer is selling these is it okay to buy them? They did not appear to be pinned and the plastic bag clearly said 15rd. The sales associate confirmed they were indeed the 15rd mags.
Darn, if I didn't already have a box of Glock 19 mags I would pick some up. I like the P-Mags and have had good luck with them. Plus they are generally around $15. And yes, I am LEO exempt for those that put stupid comments on my last posting.

I don't think you'd face any prosecution unless you admitted to knowing it was illegal. But I wouldn't put it past MSP to try and track you down and make you surrender the mags.

You misunderstand. Dicks would never make such a blatant error. Those mags were "for law enforcement only" Cause, ya know, LEOS always go buy their own firearms and accessories. Their agencies never provide that kind of equipment. :sarcasm:
