This does not mean what you think it does.

This spells out when someone convicted of a disqualifying crime must transfer thier firearms to a FFL or a law enforcement agency. And how to provide proof you have complied.

I believe it requires transfer of regulated firearms to an FFL or private party within two days of conviction for a domestic violence charge. You lose your 2A rights, and have to dispose of all firearms, and prove to the Court that you have done so within five days after the conviction.

How do you prove you don't have any more guns?
No way to prove a negative.

There you go, applying logic to Maryland gun laws again.

Besides, Maryland is now the only state in the world that still follows the Napoleonic code. where you have to prove you're innocent, not the other way around, since the French finally gave up on it.

This is the Bill Deb Rey was talking about and the "woman" from everytown was telling her she needs to support

Per Deb Rey law states today if you are convicted of DV you cant be released till the firearms are transferred this bill will give you two days. This law seems like a disaster waiting to happen

In reading the bill, it seems worse than that. It lists 3 separate categories: Regulated firearms, rifles, and shotguns. This basically sounds like pretty much anything except C&R. It also says that it must be transferred to a LEO or an FFL. Nothing about a regular private party. They mention that you can have a representative turn in the weapon for you. There is also no mention made of compensation if you decide to go the FFL route.

There IS a catagory not mentioned ( that I won't mention either , and would still be 100% illegal to posses under existing state and Fed law) , but it's not C&R . C&R would already be included under their respective catagory.

While ideally would have included non-prohibited third parties , the inclusion of FFLs is a major improvement over turning into LE only .

Of course it is subject to negeoation between someone in that situation and the FFL, but potentially includes :

    Purchase outright
    Place on Consignment
Transfer to third party ( either your designated, or sale that you arrainged otherwise ).

Would you rather the alternative? Just have MSP come and confiscate all your guns and never get them back. This bill as I understand it gives you time to transfer your firearms instead.

I'd rather them just not have anything to do with firearms. If you can't be trusted with a gun you should be in jail

No free man shall be disbarred the use of arms.

It use to take a felony to be a prohibited person. Now every crime under the sun makes you prohibited

And people that support that prohibited oerson bull shit are worse than the gun banners themselves.

If it is a choice of sitting in jail until trial or having to turn over my firearms to someone else, I’d rather turn over my firearms. It galls me that a private party isn’t an option if they don’t reside in your house.

As a prohibited person you aren’t barred from OWNING firearms. You just can’t be in posession of them. It does mean you are prohibited from purchasing new ones. But as the law is today, I could have my brother-in-law store all of my stuff at his place so long as I didn’t have access to it.

Of course they are trying to make it so that ANY “loan” is a transfer (see new regulated firearms transfer bill). And of course this one effectively bars you from owning the firearms. Though I guess you could work out a long term storage arrangement with an FFL.

Add an affidavit requirement for private party transfer so that you and the person receiving attest to the arrangement and that you have no access to the firearms. Call it a day.

I've often wondered how it can be constitutional to take an enumerated right for some unrelated and minor violation. Unfortunately, without the supreme court intervening......

    I have a question:

What happens if the charge is found to be bogus post-conviction, and the conviction is expunged? Do you get your weapons back?

This being the Socialist Utopia that it is, I would think not, but...
