True but there are other circuits where, if you get the right plaintiff you would have a situation where they are effectively blocked from carrying.
For example, in Philadelphia as well as for car carry throughout PA, a permit is required. That permit must be a reciprocal resident permit. Well...
I don't think so. They could file in OR state court as a potential option. But if we wanted this to go back to SCOTUS, it would require a loss somewhere in all likelihood to create a circuit split.
The main problem with CA9 is they take forever, not to mention if the 3 judge panel actually...
Unlicensed open carry would probably undercut that, also DE has reciprocity and recognizes permits where the holder is a non-resident. Probably wouldn't be the best place for a lawsuit.
In addition to the places mentioned above, Oregon has some towns with open carry bans, and they don't issue...
The opinion is basically putting this guy in the same category as non-violent felons/misdemeanors. It is interesting to note this illegal alien chose to get armed in response to the "Summer of Love" in 2020.
But yea I don't see this as holding. The opinion is basically just trying to make...
If you recall, the big orgs for whatever reason weren't backing his case initially. It eventually survived and lasted years and years through district courts, 3 judge appeals, en banc, SCOTUS remand, finally ending quietly as a settlement.
RIP
In a case like this the lawsuit should target the state to explain why this law is necessary now. As I see it, all this is doing is forcing a firearms course on the same group of people (lawful non-prohibited persons), which essentially is trying to cut down on accidents.
Has there been an...
How are the state police going to train everyone? Seems like a clear play to make it more difficult (aside from requiring the permit) to get the training.
The state police will view the training as a low priority I'm sure.
It references individuals and not residents, so yea anyone (non-prohibited) 18 and older.
Looks like the SC senate got their way and there's going to be free training. Curious to see if the classes get filled up and private trainers start losing business, or the state will just hire them outright.
I think 4 boxes diner had a video on this saying that this could really backfire on them. This is such a bad hill for the 9th circus to die on. SCOTUS unanimously remanded the MA stun gun case, which IMO would be a harder call to make then a knife case.
Very nice. This is what happens when leadership is all on the same page and you don't get desk drawer vetoes and poison pill amendments (looking at you, SC).
I'm curious why we haven't seen any non-resident CCW cases filed post Bruen?
SAF used to be all over that. The 7th circuit case out of IL pre-Bruen was a complete sham of an opinion and is ripe for overturning.
