I witnessed the distress my father encountered with pneumonia while the hospital vacuumed his lungs periodically. He survived it, but it sure is nasty.

Can't help it...penalties that aren't enforced have no repercussions. Mandatory 5 hasn't been meted out ever, as far as I know.
