Abramski v US cert petition ("straw purchase" for otherwise legal buyer)

No, I didn't know that. I guess you know hookers better than I do.

And here's another interesting example for your collection. Consider the recent case of United States v. Castleman (Supreme Court No. 12–1371, March, 2014). That was a very interesting lining up. The Court ruled unanimously that a Tennessee misdemeanor battery conviction was, under the facts...

Because it's not. I've given one recent example.

Every decision does not fall along party lines. Consider Navarette, et al v. California (Supreme Court No. 12–9490, April, 2014), a Fourth Amendment case in which Thomas wrote the majority opinion in which Roberts, Kennedy, Breyer, and Alito joined. Ginsburg, Sotomayor, and Kagan joined in the...

Abramski v US cert petition ("straw purchase" for otherwise legal buyer)

The exercise of judicial power and the deciding of cases arising necessarily involves interpreting and applying the law to the circumstances of the matter in controversy in order to decide the dispute. As Chief Justice John Marshall wrote in the decision in Marbury v. Madison, 5 U.S. (1 Cranch)...

Abramski v US cert petition ("straw purchase" for otherwise legal buyer)

It's not a matter of me regarding anything. It's a matter of reality. That's how things work. The decisions courts make will affect the lives and property of real people in the real world. And past decision of courts of appeal will affect future decision of other courts. There's nothing...

Good God. I thought I was done with your silliness when I put you on "ignore" at Calguns. I guess I'll have to ignore you here as well. During by career when actively practicing I dealt with legal matters all across the country, as well as federal matters.

Enjoy your delusions, but the world has functioned and will continue to do so without regards to your opinions. In the meantime, some of us have accomplished things in the real world.

Abramski v US cert petition ("straw purchase" for otherwise legal buyer)

Sorry, but Dred Scott is a dead issue for a variety of reasons including, most specifically, the adoption of the Thirteenth Amendment. It's really not the proper role of a court to decide if the result is good or bad. It's the job of a court to apply the the law and applicable precedent to...

Actually, the Supreme Court in Abramski confirmed the ATF's interpretation as the correct application of 18 USC 922(a)(6). And furthermore, it's useful to note that nothing has changed. The ATF has been using that interpretation since 1992.

TN District Court dismisses civil suit

Nonsense and ignorance. It's your opinion of how the Constitution applies that is meaningless. Case law, whether you consider it good or bad determines what the Constitution means and how it applies. A court's opinion on matters of law, including the application and interpretation of the...

TN District Court dismisses civil suit

An important point, Al. If Embody had just taken his lumps in the District Court and gone on with his life, we wouldn't really have much to worry about. The District Court ruling really is not precedent that must be followed, although it could influence other courts. But Embody insisted...

TN District Court dismisses civil suit

Except Embody wasn't hunting and wasn't anywhere hunting is permitted. He may have broken no law, but the District Court concluded that as a matter of law his detention was appropriate. In doing so the District Court gave us some unfortunate language regarding the Second Amendment which, if...

TN District Court dismisses civil suit

But we need to recognize that our problem is that the District Court in granting the defendant's motion for summary judgment stated that (Embody v. Ward, No. 3:10cv-00126, 20 July 2011, at pg 11): It would not be in our interests for that to stand. Given the District Court's ruling on the Second...

TN District Court dismisses civil suit

Since I saw Southwest Chuck and Al Norris here, I figured I might as well drop in. I first ran into Kwikrnu at TFL (as Al mentions), or maybe it was THR. In either case, he's not in either place any more, nor has he been for some time. I was participating in the Calguns thread. I wondering...
