I will never volunteer that I'm carrying unless in a state that requires it and certainly won't mention the word "gun". If asked I'll respond appropriately and ask how they'd like to proceed and I will not be removing said firearm from the holster with my own hands. The amount of ccw stories with the officer removing a perfectly safe firearm and returning it in a plastic baggie emptied on the premise of "officer safety" is both funny and worrisome.

This video was posted on the FB md gun owners page. Its a gun store and instructor who got pulled over with his gun. Its the SP body cam footage. They talk about how the headquarters wants them to run all the guns they encounter.

The police were respectful; but I still found the whole thing disturbing.

I’m sorry, what does post count have to do with one’s freedom to engage in beating a dead horse? There’s now 10 pages of this crap including people with post counts in excess of 10k…

I didn’t realize we were gate-keeping the non-legal advice party… I’ll be sure to keep just lurking instead of posting, that way I can always be new here so you can always have someone to feel better than :indiffere

The entire content of this sub-forum is about what is or is not required by law… and doing what you feel comfortable with regardless of that…

I figure you’ve been here long enough to realize that?

Yeah. Now I’m definitely not saying whether I have a gun.

around the 2 minute mark they were saying something like hope he doesn't have a car full of guns cuz they'd be there all day running them.

Hope this isn't SOP for every department

No, it is not a crime to say that you don't have a gun. If you are legally allowed to possess it, Maryland law does not compel you to tell an officer, nor does it make it a lie to deny having it.

That said, I encourage law abiding citizens to tell an officer they are legally carrying when stopped. That lets me, the officer, know that you are not a criminal, you've passed a background check and are unlikely to be some idiot committing crime. That can drastically quicken the length of a traffic stop and result in favorable outcome for you, the law abiding citizen.
Not trying to be a dick, but why is it on me to offer up extra information to try and ease you? I'm in the if not asked don't tell camp. If I get pulled over for a traffic violation and am polite and courteous to the officer (I always am). Why inject irrelevant information? I'll take my warning or ticket and be on my way.

The exercise of an enumerated RIGHT (2A) does not allow the tyrants to suspend another enumerated RIGHT (4A). No mental gymnastics need to be done here on my part. My lawful exercise of the 2A does not give the police the right to run my gun. That is also a 5A violation.

"I am exercising my 5th Amendment right to not answer any questions not directly related to the purpose of this traffic stop. Am I free to leave?"

If I wanted to be rude, I could go in a different direction: "Do you have a DNR license for your little fishing expedition?"

Seems like that caused added delay in the length of the detention. At some point that in itself is a rights violation, even if the stop is legal. Having multiple weapons, taking the extra time these officers jokes about, could extend it past what is considered reasonable.

He was compliant, with no objections. But there are SCOTUS issues with running serial numbers in Arizona vs. Hicks. That was about police finding stolen stereo equipment, but as they had to move the equipment to see the serial numbers, it was not considered to be covered under the “plain view doctrine.” Stereo, gun, phone, they don’t just get to run the numbers and “hope” for a crime.

Having the weapon in the holster would normally cover any serial number. It would take action on their part to be able to see any serial #. My former carry weapon of a decade or more had a small piece of black tape covering the serial number as an added level of them needing to take even further steps to violate my rights. That was never tested.

I would be compliant, and cordial, with objections, in a similar situation. I’m not going to argue with LEO alongside the road. But will assert my rights, and deal with the repercussions after the fact. The one officer there sounded fairly new. Agitating and escalating a situation with weapons involved can turn bad quickly.

The exercise of an enumerated RIGHT (2A) does not allow the tyrants to suspend another enumerated RIGHT (4A). No mental gymnastics need to be done here on my part. My lawful exercise of the 2A does not give the police the right to run my gun. That is also a 5A violation.
Exactly. Make sure to verbally announce that you are choosing to assert each of those rights, especially your 5th A right.

Do the FOIA requests for everything after the fact and let your lawyer get the check.

It my not be a bad idea to record any fishing expeditions on your cellphone.

Sure you can search me, if you can articulate which law(s) you believe I violated. Otherwise, pound sand.

Definitely. Accessibility of your own video is instant, verses having to wait weeks or months for their video and files, if they release anything at all. Active investigation, lost or malfunctioning video, forgot to activate, many ways to delay or deny.
