It doesn't have to. Courts can issue injunctions on an emergency basis within days. And I think with how NY is showing they are willing to F around, injunctions are going to start coming on more extreme gun control bills and ones that are pretty obviously (or even most likely) ignoring SCOTUS decisions and instructions to the lower courts.
If not from the lower courts, than the higher courts or SCOTUS. I dislike the shadow docket, but when it comes down to it, they HAVE that power and if states are obviously and willfully ignoring the letter, which they are in this new NY slate of laws, as well as the spirit (they've exorcised that spirit for sure!), expect SCOTUS to hand down quick injunctions. All you need for them to do that is the district court and appeals court to deny an injunction, and there is no reason it should take more than a few weeks at each level to decide on preliminary injunctions.
That’s the point I was trying to say earlier.
They might not issue injunctions for minor not so extreme cases. But extreme blatant disregard for SCOTUS I bet they will.
It wouldn’t take to long to request an emergency injunction of a SCOTUS shadow docket for that to happen.
However, Justice Sottamyer is in for the 2nd circuit which covers NY and NYC so that might be an issue. Every circuit but the 2nd and 9th the two worst, are in Our control.
So the shadow emergency docket for injunctions might be an issue. at least for 2nd and 9th,
But not impossible.
Suffice it to say.. they are fighting a loosing battle.
One other thing to note. As I write this. There are actually two cases requesting at district court level, one in the 9th and one in the 2nd. One against CA and other against NYC for an immediate and permanent injunction enjoinment and invalidation of laws.
One filed I think on the 29th, the other on the 30th,
Lets just see how long it takes them to deny or grant.
