It doesn't have to. Courts can issue injunctions on an emergency basis within days. And I think with how NY is showing they are willing to F around, injunctions are going to start coming on more extreme gun control bills and ones that are pretty obviously (or even most likely) ignoring SCOTUS decisions and instructions to the lower courts.

If not from the lower courts, than the higher courts or SCOTUS. I dislike the shadow docket, but when it comes down to it, they HAVE that power and if states are obviously and willfully ignoring the letter, which they are in this new NY slate of laws, as well as the spirit (they've exorcised that spirit for sure!), expect SCOTUS to hand down quick injunctions. All you need for them to do that is the district court and appeals court to deny an injunction, and there is no reason it should take more than a few weeks at each level to decide on preliminary injunctions.

That’s the point I was trying to say earlier.

They might not issue injunctions for minor not so extreme cases. But extreme blatant disregard for SCOTUS I bet they will.

It wouldn’t take to long to request an emergency injunction of a SCOTUS shadow docket for that to happen.

However, Justice Sottamyer is in for the 2nd circuit which covers NY and NYC so that might be an issue. Every circuit but the 2nd and 9th the two worst, are in Our control.

So the shadow emergency docket for injunctions might be an issue. at least for 2nd and 9th,

    But not impossible.

Suffice it to say.. they are fighting a loosing battle.

One other thing to note. As I write this. There are actually two cases requesting at district court level, one in the 9th and one in the 2nd. One against CA and other against NYC for an immediate and permanent injunction enjoinment and invalidation of laws.

One filed I think on the 29th, the other on the 30th,

Lets just see how long it takes them to deny or grant.

Dems aren't willing to go remotely as far as the GOP is in their tactics. For example, the GOP has been more than happy to shut down the government and stop the Senate from working to get what they want. The Dems so far haven't. They've...been willing to get rid of the filibuster for non-SCOTUS nominations and that is it.
I don't see the RIght as willing to go full criminal. The Progressives were happy to burn down cities and keep the police at bay while it happened. They were pleased to ignore the evidence that there was - and still is - big financial support to up the violence content of the riots they engineered into being.

Murder is part of the playbook, and always has been, in every country, for most of recorded history. The composition of SCOTUS is the first, and at this point only effective, impediment thrown in their way since Bush I.

I'd say that the five Conservative Justices are at extreme risk at this point in time.

And the right was happy to attack peaceful civil rights protestors and burn down Black Wallstreet in Tulsa. Or storm the Capitol on 1/6/2021.

If there is anyone here who is upset by this ruling thinking it just made everything worse for people in those 6 states and wishes that NYSPRA hadn’t pursued this case, you’re part of the problem.
I cannot fathom how supposed pro 2A people are more worried about temporary inconveniences for people with permits in those states instead of EVERYONE finally being able to exercise their 2A rights.
Enough. It’s time to fight back (figuratively), vote, be involved, support MSI and the SAF, and support current and future cases to get our rights back.

Everyone has been in fact applying to all these May Issue states in droves.

I still think they are going to be hard pressed, if they start denying all these applications in the thousands, and find that their appeals process gets bogged down In The thousands, and cases start get filed in federal courts in the thousands.

If they think good moral character is enough they will start thinking twice when they start loosing appeals left and right.

The big trick is to get your application submitted BEFORE any of the new laws take effect.

Mine will be going tomorrow night.

My kids are respectful, but not trusting. 18&20.
My daughter got pulled over in my car for a very odd license plate issue. She “wouldn’t answer questions” until she spoke with me. Good girl.

Good on her. Good on you for raising her well!

    Bronx defense attorneys:

Well, too late for the last bit.

But, how constitutional carry is going to happen: Judges decide to dismiss prosecutions for constitutionally protected activity.

This is going to happen. NY is going to risk an appellate ruling cementing constitutional carry, because they are arrogant. I am not sure if MD is that dumb. I am coming around to the idea AG Frosh is.

    tick tock.

Their amicus brief is my favorite of any submitted in any gun case.

This is what gun control really looks like.

Anyone that giggles when they shoot an M1 Garand (or M1A, I can't remember because I'm old) and crushes mailboxes for sport is ok in my book.

It needs to comply with the 1-step test, and THT. Tougher than strict scrutiny.

    It can’t survive.
I am not sure I would describe THT as tougher than strict scrutiny. It is different and I believe Thomas thinks it may be less susceptible to manipulation. I am not convinced of that because both sides though history was on their side in Bruen.

If the 4CA had decided Kolbe on intermediate scrutiny, I would be more certain of the outcome. While it is a backup reason, they said the "assault weapons" were not even part of the 2A. I am not sure how that may play out in a circuit that has 9 judges that are likely to agree with the Kolbe precedent compared to 5 that don't.

Anyone here who doesn't remember Antonin Scalia?

Anyone here remember the assassination attempt on Kavanaugh?

Anyone here think that the Globalist Progressives are not and will not agitate the masses to encourage assassination of Conservative SCOTUS justices? Kill two and it's game over for the nation.

We still have two years of The Drooler and his Ho, we still have the same mechanisms available to invalidate a fair election, and we have a scant four months to go before the midterm elections.

These people have killed to keep their positions, and they are supported by intelligence assets who are fully in favor of continuing on the current path. They play for all the marbles in a game without rules.

Just because I seem paranoid doesn't mean I'm wrong. I'd like to be, but I really think these folks will stop at nothing. I've seen nothing that would change my mind about their zeal, their sociopathy, their cunning and their absolute commitment to keeping and increasing their power.
    Aw, c'mon man! Nonsense.

Brennan, Clapper, Comey, McCabe, Strzok, Page, Ohr, Mueller, Weissman, Schiff, Swalwell, Schumer, Pelosi, Clinton, Brandon, Harris, -0-, Jarrett, Rice, and the rest of them all took an oath of allegiance to the Constitution.

    Therefore, it would be improper.

    lol. Not true.

Ask Harry Reid (oh, he dead). Ask the FBI (Mueller Probe, RUSSIA! RUSSIA! RUSSIA! hoax) Ask Congress about two (2) hoax impeachments of a sitting President. Ask BLM. Ask Antifa. Dems just call out their militant thugs when needed.

When I think of all the school shootings that have happened on our watch, It is ludricrous to me why schools should continue to be "gun-free".

What did that fellow say? Something about "a good man with a gun?"
Schools aren't "gun free," as we have seen (but not learned).

Lol, when is that last time the GOP shut down the government and got what they wanted?
