    Their rework of the receiver rule should be effected as well. The AR defies the legal description of receiver as the upper and lower are two distinct parts, neither one solely encasing the action

    several cases were quietly dropped after big production raids and confiscation .

    Since the ATF has no legislative authority and is basically creating new law with their new rules, they are in violation of their Congressionally granted limitations.
    Couple this with the recent ruling on the NY case, and they are clearly attempting to circumvent The Second Amendment.
    When exactly does it become a citizen's duty to ignore tyrannical rules?!
    Agencies to have some legislative authority that is granted to them by Congress and the enabling legislation. They cannot exceed that authority however.

    We will have to wait until Dec to figure out how much they overstep their bounds with braces, but the proposed rules seem to suggest they will. They did tone back the receiver rules, but it still seems that they did exceed their authority.

    The ATF estimates that there are approximately three million pistol stabilizing braces in circulation. Although the ATF acknowledges that they are vastly undercounting the actual number of pistol braces in circulation, using the three million number * $200 a tax stamp, the ATF has now lost $600,000,000.00 in revenue.

    Some of the pistol brace companies estimated somewhere between 10-40 million when asked by house members.

    The easy way for them to regulate them without running afoul of the ADA would be for you to be required to have a doctor's note that you are disabled in order to not pay the $200. Kind of like having to have a blue disabled tag to use a disabled parking spot.

    I'm wondering if the WV vs EPA decision might also have implications for the 80% / home made firearms rule and the solvent trap parts = suppressor rule. I'm thinking it will.
    I am thinking that any ATF regulation without supporting legislation is toast. Bump stocks, ghost guns, and 80 % rules are all subject to challenge.

    A TON has changed in the last 2 weeks since these two made this video (gotta give ‘em credit for not busting out laughing at ATF more) but, their valiant effort really demonstrates the absolute absurdity of the ATF’s FAIL …

    There are more cases that are going to set fantastic precedent in the legal pipeline.

    Meanwhile, ditching the 17th Amendment, the direct election of Senators, would return power to the parts of the nation from the Big City voting bloc. That would take a Constitutional Convention, but it would make a huge difference, with 95% of the country getting its representation back.

    A guy can dream, right?

    The way it should have always been. Senators just 6 year house of reps now. States legislature nrrds to choose again. Isn’t that who the senstors sre to represent? The states? House represents the people of the states

    Direct election of senators doesn't actually change the fact that a voter in Wyoming has 68x the voting power in the senate as a voter in California. Small state voters have the power directly by direct election or indirectly via the election of their state legislature. The end result in the US Senate is the same.

    The point is that state legislatures electing senators returns a measure of power to the people who live outside of huge cities.

    NY for example would have one senator from the vast areas of the state who are forever under the thumb of NYC because of the population imbalance. They deserve a voice in the senate.

    The current conservative court is rolling back 100+ year old rulings. The conservative majority is safe for the lifespan of the current justices. It was only a single presidential term that flipped the court. A single term could do that again in the other direction.

    Religious conservatives have advanced a minority agenda. They haven't had the support of the majority for over 20 years. No Republican president or Senate majority has represented the popular majority since the 1980s. It is, at its core, an unsupported agenda.

    I have offered to write a note for tinnitus and hearing loss patients stating that in order to allow them to continue their hobby, a suppressor is medically necessary. I would ask the tax stamp be covered, too. Never tried, but I do wonder how this would be received by HSA/FSAs.

    That’s probably the best I can do.

    That’s probably the best I can do.
    In most of Europe, hunters can get a suppressor because it's just makes good sense. There is simply no good rationale for restricting them.
